Based on observation, the licensee did not comply with the section cited above. LPA's observed during the visit children playing near the sliding door in the playground to the right of the building. LPA Deanna Villagrana opened the sliding door and did not see a teacher present. LPA went around the corner and observed the teacher sitting in a chair to right of the building with no view towards the sliding door. Children were not being supervised which poses an immediate health, safety or personal rights risk to persons in care.

Angela obtained an influenza waiver for staff who were present. Teacher 2 in missing influenza vaccine which poses/posed a potential health, safety or personal rights risk to persons in care.

To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by during and episode with child 1, former director Adrianna Castello was observed grabbing the child by the arm, upper torso area and moving the child from one location to another. As a result, the child received scratches on their body. This poses an immediate risk to the Health, Safety or Personal Rights to children in care.
