Inspector’s narrative

What the inspector wrote

During the visit conducted on 06/24/2025, LPA conducted a walk through of the facility, observed the environment, and spoke with several staff members. No unusual or strong odors were detected during the visit, including in or around the adult bathroom. During the initial investigation process, interviews were conducted with staff members; however, consistent statements were not received. The information collected lacked cohesion, and there was not a substantial amount of evidence available at the time to support or verify the reported allegation. As a result, the complaint was originally concluded as unsubstantiated due to insufficient and conflicting information. Following the closure of the initial investigation, LPA received new and relevant information regarding the complaint allegation. It was reported that the subject teacher was sent home and subsequently terminated by the facility for allegedly smoking marijuana on-site during break times. It was also reported and noted that the teacher carried a strong odor of marijuana at the time of the incident. During today\342\200\231s visit, LPA obtained additional documentation, including a written disciplinary notice issued to the subject teacher regarding smoking at the facility and the odor of marijuana. This documentation, along with the previously received information, provided sufficient basis to now substantiate the allegation. Based on interviews of pertinent individuals that were conducted, and a review of additional pertinent information obtained, the preponderance of evidence standard has been met, therefore the above allegation of Buildings and Grounds is found to be Substantiated. See LIC 9099-D for cited deficiency. Due to the severity of the allegation, a consultation was held with the Interim Director. Interim Director provided LPA with a updated employee handbook policy that includes and enforces Hygiene and a Drug-Free Workplace. The new policy includes a Hygiene and a Drug-Free Workplace, Personal Hygiene, Prohibited Items, and Reporting Suspicious Activity. A notice of site visit was given and must remain posted for 30 days. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview conducted and report was reviewed with Interim Director DeDe Simpson.

    Title 22 Regulation - 101238(a) (Building and grounds) states: The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement was not met as evidenced by: Staff reports and interviews indicating the subject teacher carried a strong odor of marijuana and had allegedly smoked on-site during break times. LPA collected a disciplinary write-up confirming the teacher was sent home and later terminated due to the incident.
