During the course of the investigation, LPA conducted an interview with the subject staff member. The subject staff member denied allegations of using profanity at the facility and in the presence of children in care. The subject staff member also stated that they do not use profanity in general. Several pertinent staff member interviews were conducted, and none of the staff members disclosed hearing or witnessing the subject staff member using profanity or other inappropriate words in the presence of children. However, information possibly corroborating the occurrence of the incident was obtained, but not substantial enough. It was stated that a staff member was made aware of the subject staff member's conversation that may have occurred in the presence of children. Due to young age, children within the infant license were not able to be interviewed. Overall, the Department received conflicting information throughout the course of the investigation. This agency has investigated the complaint regarding the above allegation of Personal Rights. Based on the interviews conducted and information obtained during the investigation, the allegation is UNSUBSTANTIATED. A finding of unsubstantiated means that although the allegation may have happened, or is valid, there is not a preponderance of evidence to prove the alleged violation occurred. No deficiencies were cited during today\342\200\231s visit. A notice of site visit was given and must remain posted for 30 days. Failure to maintain posting as required will result in a civil penalty of $100.00. Exit interview conducted and report was reviewed with Interim Director Laura Salazar.
