What the inspector wrote

Licensing Program Analyst (LPA) Taityana Benson conducted an unannounced visit to the facility for the purpose of following up on the submission of an Unusual Incident Report (UIR) that was submitted by the facility. The initial UIR was received by the licensing agency on 05/09/2025. An additional UIR was received by the licensing agency on 05/14/2025. The UIRs documented an incident involving a day-care child. LPA was granted entry into the facility and met with Director Michelle Martinez to discuss the purpose of the visit and conducted a tour of the facility to obtain census. The UIRs received by the licensing agency documented a day-care child sustained an injury to their left arm on 05/08/2025, while in care at the facility. Facility records were reviewed, documentation was obtained, and interviews were conducted with pertinent parties. It was disclosed that on 05/08/2025 while day-care children were on the playground, a staff member was present but not observing day-care children when a day-care child sustained an injury to their left arm. I t was revealed that on 05/08/2025, a staff member was present on the playground but did not witness a day-care child fall off of play equipment when other day-care children were in their path. The day-care child fell, landing onto the wood chips. The day-care child immediately held their left arm and notified the staff member. The injury to the day care child's left arm resulted in medical attention. The LPA inspected the outdoor play equipment which was not damaged, and wood chips are under the play equipment to cushion the day-care child\342\200\231s fall. The facility followed their emergency plan, applied first aid, contacted parents, and provided parents with a electronic report. Lastly the facility terminated the staff member and updated the facility playground staff supervision requirements and procedures. Report Continued On LIC809-C See LIC9099-D for deficiency cited per California Code of Regulations Title 22, Division 12. A Civil Penalty has been assessed during this inspection. Payment is due when billed and the check(s) or money orders shall be made payable to the \342\200\234California Department of Social Services\342\200\235. YOU WILL RECEIVE AN INVOICE IN THE MAIL. DO NOT SEND MONEY UNTIL YOU RECEIVE YOUR INVOICE. DO NOT SEND CASH. LPA Taityana Benson informed Director Michelle Martinez, that this report dated 05/21/2025 documents a Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Also, LPA Taityana Benson informed the Director Michelle Martinez, to provide a copy of this licensing report dated 05/21/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report LIC 9224, or other written statement, must be placed in the child's file for verification. An exit interview was conducted, and report was reviewed with Director Michelle Martinez.

This regulation was not met as evidenced by: Based on observation, surveillance video, interviews, and record review, the facility staff failed to provide care & supervision necessary while a child in care obtained an injury that resulted in medical attention, which poses an immediate health and safety risk to persons in care.
