Based on record review and staff admission, the licensee did not comply with the section cited above. Although the center is conducting 15 minute sleep logs for infants up to 12 months of age, they were not conducting them for infants from 12-24 months of age. C3 and C4 did not have proof of 15 minute sleep logs on file. This poses/posed a potential health, safety or personal rights risk to persons in care.

101223(a)(2): The licensee shall ensure that each child is accorded the following personal rights:(2)To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement was not being met as evidenced by: Per staff’s own admission and facility records obtained during the investigation, an infant was hitting the classroom door with their hands and head for approximately 3-5 minutes, “so hard that the infant bumped their forehead in borders of the edge of the classroom door” which resulted significant bruising and swelling; an additional injury occurred a few hours later causing a second injury in the same area on the forehead. At pick up point, child was taken to the doctor immediately due to parent concerns of internal head bleeding and behavioral changes due to the child's allegedly “lethargic” state. This posed an immediate health, safety, or personal rights risk to the subject child and children in care.

REPORTING REQUIREMENTS

101212(d)(1)(C) Reporting Requirements. Any unusual incident or child absence that threatens the physical or emotional health or safety of a child shall be reported to the Department within 24 hours of the occurrence. This requirement was not met as: facility failed to report the second incident to Community Care Licensing within the allowed time. This posed an potential risk to the health, safety, or personal rights to the subject child and children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229(a)(1): Responsibility for Providing Care and Supervision: No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not being met as evidenced by: On 09/06/23, an infant suffered a head injury that resulted in significant bruising and swelling of the forehead in which medical attention was sought, per staff’s own admission, the incident occurred while staff was changing a diaper for another child who was really dirty, no direct visual supervision was provided to the subject infant while the diaper change was in progress. This posed an immediate health, safety, or personal rights risk to the subject child and children in care.

INFANT NEEDS AND SERVICES PLAN

Based on record review, facility did not comply with the section cited above C2's file did not have Lic 9227 available for review which poses a potential health, safety or personal rights risk to persons in care.

Based on file reviews during this inspection, facility did not comply with the section cited above Child N.1, Child N.2 and Child N.3 files did not have copies of LIC9224 which poses a potential health, safety or personal rights risk to persons in care.

Supervision shall include visual observation. This requirement was not being met as evidenced by the information obtained that a child suffered numerous scratches that required medical attention, and out of three staff members present in the room, no one saw the incident develop and/or out how it occurred. This poses an immediate health, safety, or personal rights risk to children in care.

CHILD'S RECORDS

Child's Records: A separate, complete and current record for each child is maintained in the child care center.This requirement was not met as evidenced by: Due to facility staff being unable to provide a child's file to licensing. All children's records and files must be available to the Department to inspect during normal business hours. This poses a potential risk to the health and safety of children in care. Plan of correction discussed with acting assistant director.

Food Service:The infant shall be fed in accordance with the individual plan. (1) Bottle-fed infants shall be fed at least once every four hours.This requirement was not met as evidenced by: Based on staff admission, bottle feeding logs showing child was not fed for more than four hours at a time, and incidnet report. This poses an immediate risk to the health and safety of children in care. Plan of correction discussed with acting assistant director.
