What the inspector wrote

Licensing Program Analyst (LPA) Kim Leung conducted a complaint investigation at the facility this date on 8/11/2021. During the investigation process, LPA obtained information that there were in multiple mornings in or about June 2021, due to insufficient teaching staff scheduled to work in the morning, some children were made staying with the front office staff in the front office behind the counter for extensive period of time waiting for additional staff to arrive to work before they were taken to their assigned activity rooms. LPA obtained information that some children were in the staff room while waiting to be taken to their assigned activity room or the playground joining their class. LPA also obtained information that some children were made staying in the director's office with the previous director due to insufficient teaching staff to maintain proper ratio in each class. LPA obtained information that the children were watching movie using the office computer while staying in the director's office. The front office areas and the director's office are not licensed as children's activity areas and the areas are not furnished with age-appropriate furniture and equipment. The front office area, director's office and staff room are not considered age-appropriate for child care activities. See LIC809D for deficiency cited per California Code of Regulations Title 22, Division 12 for violation of the children's personal rights. An exit interview was conducted with Ms. Holtegarrd. Appeal rights discussed, Notice of Site Visit was issued and must be posted for 30 days. A copy of this report was provided to the facility. Ms. Holtegarrd was provided with a copy of the appeal rights (LIC9058 12/2015) and her signature on this report acknowledges receipt of those rights. A COPY OF ALL TYPE A DEFICIENCIES (LIC809D) CITED DURING THIS INSPECTION MUST BE POSTED FOR 30 DAYS. A COPY OF ALL TYPE A DEFICIENCIES CITED DURING THIS INSPECTION MUST ALSO BE IMMEDIATELY (within 24 hours of the child’s next day in care) GIVEN TO THE PARENTS OF ALL CHILDREN ENROLLED IN THE CHILD CARE FACILITY AND ANY CHILDREN ENROLLED INTO THE CHILD CARE FACILITY OVER THE NEXT 12 MONTHS. This report must be made available at the facility for 3 years for public review upon request.

This requirement was not met as evidenced by: In or about June 2021, there had been at least two different occasions that children were left unsupervised while staying in the front office area waiting for additional teaching staff to arrive to work in the morning. The children were in the hallway around the corner of the front counter and in the staff room without any staff member physically present with them in the same area. That presented immediate risks to the children's health and safety.

    Personal Rights. The licensee shall ensure that each child is accorded...accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced by: In or about June 2021, due toinsufficient teaching staff to maintain proper teacher-child ratio in the class, some children were made to stay in the front office, staff room and the director's office with office staff for extensive period of time. That was a violation of the children's personal rights as those areas are not licensed as part of the child care activity areas and not age-appropriate for the children.
