What the inspector wrote

It was also disclosed that one child in the bathroom started yelling as the other child ran out of the bathroom. Further, it was disclosed that this was when the staff member then was visually able to see both children in care. During the complaint inspection, LPA observed two separate bathrooms with one toilet each. Each bathroom has its own barn-like doors, where a teacher can see over them. LPA informed the facility that according to Title 22 Regulations, visual supervision must be provided to children at all times. Based on interviews of pertinent individuals that were conducted, and a review of additional pertinent information obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. LPA informed Director and Assistant Director that this report dated 06/12/2024 documents one Type A citation which shall be posted for 30 consecutive days as there was an immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed the Director and Assistant Director to provide a copy of this licensing report dated 06/12/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. An exit interview was conducted with the Director and Assistant Director, Appeal Rights were discussed and issued, a copy of this report was provided, and a Notice of Site Visit (LIC 9213) was issued. The Notice of Site Visit shall be posted where the parent/guardian of children enter and exit the facility. The Notice of Site Visit must remain posted for 30 consecutive days. Failure to maintain posting as required will result in a civil penalty of $100.00. A copy of this report must be made available for the next three years. See LIC 9099-D for cited deficiency.

    101229 - Responsibility for Providing Care and Supervision(a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. Based on record review, the facility did not comply with the section cited above. Pertinent interviews disclosed that two children were briefly left unsupervised leading to an inappropriate action occurring in the bathroom. This posed an immediate health, safety and personal rights risk to persons in care.
