101223 Personal Rights (a)(2)(2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.This requirement was not met as evidenced by: Based on interviews and record review, it was determined that staff administered the wrong medication to a child in care, resulting in the child being taken to the doctor as a precaution. This posed an imediate health and safety, and personal rights risk to the child in care.

101238 Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.This requirement is not met as evidenced by: Based on observation and interview, the facility had debris on the floor of the preschool classrooms including food, dust, discolored marks on the floor, and brown and black marks on the floor of the restrooms and base of the toilets that children use. Also, there were brown markings and trash on the floor of the kitchen that is utilized for the entire facility.

Based on the information obtained during today's visit, it was determined that Title 22 Regulation section 101229(A)(1) (Responsibility for providing Care and Supervision) was violated. The Regulation states that no child(ren) shall be left without the supervision of a..... teacher at any time...Supervision shall include visual observation. It was determined that a preschool child's class transitioned into their classroom and one child was left in the breezeway playground. However, the subject child was observed by a nearby school-age teacher for the whole time until the child was walked back to their class.

101229 - Responsibility for Providing Care and Supervision(a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. Based on record review, the facility did not comply with the section cited above. Pertinent interviews disclosed that two children were briefly left unsupervised leading to an inappropriate action occurring in the bathroom. This posed an immediate health, safety and personal rights risk to persons in care.

This was due to the facility's heating was not working. This took place on 01/09/2024 and 01/10/2024. The facility's heating system was fixed on 01/11/2024.

(1) Storage areas for poisons shall be locked.This requirement was not being met as: cleaning supplies were observed by LPAs in the lower shelf of the upper cabinet unlocked as teachers arrived and left their purses on shelf upon arrival to the classroom. Classroom: Preschool and Discovery Preschool. This posed a potential health and safety risk to children in care.

This requirement is not met as evidenced by: Based on interviews, staff did not ensure they were applying the correct diaper rash cream on children in care causing one child to be in severe pain and unable to walk. Additionally, due to infrequent diaper changes and/or a child not being cleaned properly, contributed to at least two children’s diaper rashes, which poses an immediate Health, Safety, or Personal Rights risk to children in care.
