What the inspector wrote

On 06/12/2024, Licensing Program Analyst (LPA) Raymond Moorehead conducted a case management inspection with Tracy Bierman, Director and Ann-Marie Schoben, Assistant Director. A case management inspection is being conducted in response to the receipt of an Unusual Incident Report (UIR) from the facility. The UIR was received by the licensing agency on 06/07/2024 as the incident was self-reported. The UIR documented an incident where a child reportedly tripped over themselves and fell into a windowsill. The fall resulted in the child needing medical attention. The facility tended to the child with care immediately, and the child was safely picked up by a parent/authorized representative. The child has since then returned to the facility and activity is normal. During today's visit, LPA investigated the incident. Facility staff members were interviewed, documentation was obtained, a tour/census was taken. The following was disclosed. It was reported that the subject child was walking around in the classroom while the class was doing circle time. It was also reported that the subject child was not running and there were no toys on the floor to trip over. It was stated that the subject child had a stuffed animal in their hand and that they tripped over themselves and hit the windowsill. The facility provided immediate care by cleaning the affected area and applying a bandage. It was also stated that the child was picked up by a parent/authorized representative within 20 minutes of the incident occurring. LPA observed the area in which the subject child fell and hit their forehead on the windowsill. No safety hazards were observed at this time. At the conclusion of the visit, it was determined that there were no safety hazards present and that the child tripped over themselves. Based on the information obtained, there appeared to be no violations of Title 22 Regulations pertaining to the reported incident at this time. LPA conducted an exit interview with Tracy Bierman, Director and Ann-Marie Schoben, Assistant Director and provided a copy of this report. A Notice of Site Visit was issued and must remain posted for the next 30 days.

    101229 - Responsibility for Providing Care and Supervision(a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. Based on record review, the facility did not comply with the section cited above. Pertinent interviews disclosed that two children were briefly left unsupervised leading to an inappropriate action occurring in the bathroom. This posed an immediate health, safety and personal rights risk to persons in care.
