Further, it was stated that as a result of the teacher’s action, the child started to cry. However, other pertinent individuals stated that the teacher put their hand out, in order to block the child from running out of the classroom. The interviews disclosed that there was no intention to hurt the child, but to stop them from exiting the classroom, for safety. Child interviews were attempted; however, due to age and limited language abilities, children were unable to qualify for interviews. Pertaining to the facility not following diapering needs, it was reported that the child would come home with a clean diaper but would have “dried pieces of poop” on their skin. Pertinent interviews disclosed that the teachers change diapers every two hours and checks for diaper changes about five times per day. Interviews also disclosed that teachers keep track of diaper changes on diaper change charts for each child in care. It was also stated that the diaper charts are kept on paper and then inputted into the facility’s tablet. Throughout the course of the investigation, the Department has received conflicting statements for both allegations of Personal Rights. This agency has investigated the complaint regarding the above allegations. Based on the interviews conducted and documentation collected, the allegations are UNSUBSTANTIATED. A finding of unsubstantiated means, although the allegations may have happened, or are valid, there is not a preponderance of the evidence to prove the allegations occurred. No deficiencies were cited during this inspection. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with Tracy Bierman, Director.
