What the inspector wrote

On date and time listed above, Licensing Program Analyst (LPA) Raymond Moorehead arrived at the facility for the purpose of concluding a investigation pertaining to a self-reported incident report by the facility. LPA investigated a reported incident involving two children on the playground engaging in inappropriate behavior. Throughout the course of the investigation, LPA made observations, collected relevant documentation, and conducted interviews with pertinent individuals associated with the reported incident. Information obtained indicated that a staff member, while walking to an assigned classroom, observed two children in a corner area of the playground, during which one child reportedly had their pants and underwear pulled down while standing with another child. Interviews and documentation further indicated that at the time of the incident, supervising staff were present and within required ratio; however, staff were reportedly occupied with shadowing a specific child and simultaneously addressing other children involved in a conflict over a toy. Additional interviews and information gathered suggested the children were reportedly engaging in a behavior described as “playing potty.” Child interviews were unable to clearly provide sufficient detail regarding level of supervision at the exact time of the incident. Continued on LIC 9099-C. Facility administration reported awareness of ongoing behavioral concerns within this group of children and stated that staff are actively addressing these behaviors through redirection, supervision, and teaching appropriate boundaries, including reinforcing that bathroom-related behaviors are private and appropriate only in designated settings. Based on the totality of information obtained throughout the investigation, LPA confirmed that the reported incident occurred; however, insufficient evidence was available to determine that a violation of Title 22 regulations had occurred related to supervision. Although supervising staff were reportedly occupied with other childcare responsibilities at the time of the incident, available evidence did not conclusively establish a lack of supervision or regulatory noncompliance. The investigation was concluded, and at this time, there was insufficient information obtained to determine that any Title 22 violation occurred regarding the reported incident. LPA conducted an exit interview with Director Charmaine Foree provided a copy of this report. A Notice of Site Visit was issued and must remain posted for the next 30 days.
