Inspector’s narrative

What the inspector wrote

During staff interviews conducted with staff members present during the time of the incident, information obtained revealed that all staff interviewed were unaware of the incident taking place and did not have knowledge of the incident. The incident and a lack of intervention by staff resulted in a daycare child being assaulted by another child, through the pulling the other child's hair, pushing and yanking their head back and forth. The incident was documented on video footage, for a time frame of approximately 1 minute, the video footage did not show staff addressing the situation or coming to the aid of the daycare child being assaulted. Based on LPAs observation of video footage and interviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations Title 22, Division 12 Section 101223(a)(2) Personal Rights are being cited on the attached 9099D. LPAs S. Brewer and P. Ordones informed the licensee that this report dated 01/19/2023 documents a Type A citation which shall be posted for 30 consecutive days. Also, LPAs informed the licensee to provide a copy of this licensing report that documents the Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of licensing Report form LIC9224, must be placed in the children's file for verification. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and a report was reviewed with the Director, Johanna Cortes, and provided.
