Continued from page one Additional sources reported the incident was humiliating for C1. All interviews confirmed C1 did not sustain any injuries because of the incident. S1s disciplinary action to push the broom bristles into the back of C1 knees as a result of stepping in the dust pile, violated C1s personal rights. Based on the interviews conducted and a review of the records, the preponderance of evidence standard has been met. Therefore, the above allegation is found to be SUBSTANTIATED. A citation was issued on the LIC 9099D for California Code of Regulations, Title 22, Division 12, Chapter 1, regulation 101223.2 (a) Discipline. A Notice of Site Visit was given and must remain posted for 30 days. An exit interview was conducted, and the report was reviewed with facility representative Lilia Ross Vollaire. Report continued from page one Over the course of the investigation, LPA reviewed S1 personnel file. File review did not reveal evidence which corroborated the allegation. Based on the information obtained from LPA observation, confidential interviews, and record review there is not enough evidence regarding the allegation alleging staff did not accord child dignity in their relationship with staff or other persons. Therefore, the allegation is deemed UNSUBSTANTIATED at this time. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
