What the inspector wrote

On October 30, 2024 at 04:30pm, Licensing Program Analyst (LPA) Kendal Zirbes conducted an unannounced Health and Safety inspection at the Center and met with facility representatives Casie Gilham and Lilia Vollaire. LPA disclosed the purpose of the inspection and was granted entry into the facility by the facility representative. At 3:45 pm. LPA was on grounds for a different purpose and conducted a safety inspection. During the inspection, LPA observed child 1 (C1) a school age child in the Zebra preschool classroom. Staff 1 (S1) was providing supervision to C1 and five other preschool children. According to staff interviews, C1 was having a challenging day with behavior and interactions with other school age children. Therefore, the Center made the decision to moved C1 to a preschool classroom. Per staff interviews, the lead staff member was not on site therefore, the staff was unable to have C1 sit in the Administrators office. Staff expressed, C1 gets along well with the preschool age children. Staff expressed C1, was in the preschool classroom for approximately one hour. Per LPA review, the Center does not have a waiver to commingle children at 03:45pm. Based on LPA observation, the Center commi ngled a school age child, C1 with the preschool children. The Center was issued a type A citation for California Code of Regulations, Title 22, Division 12 Chapter 1, 101538.3 Indoor Activity Space for School-Age Children . Refer to the attached LIC 809D. LPA Zirbes informed facility representative Lilia Ross Vollaire that this report dated October 30, 2024, documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA Zirbes informed the facility representative to provide a copy of this licensing report dated October 30, 2024, that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. An exit interview was conducted, and this report and appeal rights were reviewed with facility representative Lilia Ross Vollaire.

This requirement was not met as evidenced by: Based on interviews, the licensee did not ensure, that S1s disciplinary action of pushing the broom bristles into the back of C1 knees, did not violate C1 personal rights. This poses a potential Health, Safety, or Personal Rights risk to persons in care.

    101216.3 (g) Teacher-Child Ratio: A teacher shall not be required to perform housekeeping or maintenance duties that prevent him/her from performing duties related to providing care and supervision to children. This requirement was not met as evidenced by: Based on interviews, teachers are responsible for cleanliness of the classroom. On August 12, 2024, an incident occurred due to S1 performing housekeeping duties rather than providing care and supervision. This poses a potential Health, Safety, or Personal Rights risk to persons in care.

  • INDOOR ACTIVITY SPACE FOR SCHOOL-AGE CHILDREN

    101538.3(b) Indoor Activity Space for School-Age Children: In combination programs, indoor activity space provided for school-age child care center children shall be physically separated from space provided for infant care and child care center children. This requirement is not met as evidenced by: Based on LPA observation, the Licensee did not ensure the school age children were separate from the preschool children, when C1 was in a preschool classroom with 5 other preschool children at 3:45pm. This poses an immediate risk to the health and safety of persons in care.
