What the inspector wrote

On October 30, 2024, Licensing Program Analyst (LPA) Zirbes conducted a case management deficiencies inspection to address additional information regarding an incident that occurred at the facility on August 12, 2024. LPA met with facility representative, Lilia Ross Vollaire. Present during today's inspection were 14 school age children. The Department discovered through confidential interviews that on August 12, 2024, at approximately 4:00p.m., staff 1 (S1) was alone and supervising 12 school age children. Confidential interviews confirmed S1 was performing housekeeping duties such as sweeping and cleaning the bathroom. S1 reported S1 was cleaning up crumbs from snack therefore an immediate safety hazard was not present. S1 reported S1 was cleaning up the classroom so the class would be able to go to the front of the facility. S1 and additional staff interviews reported the teacher is responsible for the cleaning of the classroom. Staff reported an aide is sometimes available to assist the teacher with cleaning. Interviewees reported difficulties in providing supervision and cleaning the classroom at the same time. S1 stated the broom and cleaning products are not stored in the school age classroom and were brought into the classroom by an aide or another staff member. Interviews confirmed an incident occurred between S1 and C1 involving the broom S1 was utilizing to clean the classroom. Based on confidential interviews, S1 was performing housekeeping duties rather than engaging in the care and supervision of the school age children. Therefore, a Type B citation for regulation 101216.3 (g) Teacher-Child Ratio is being issued as this was a potential risk to the children in care. Refer to LIC 809D. Notice of Site Visit was given and must remain posted for 30 days. An exit interview was conducted with facility representative Lilia Ross Vollaire. Appeal rights and a copy of the report were provided to facility representative Lilia Ross Vollaire.

This requirement was not met as evidenced by: Based on interviews, the licensee did not ensure, that S1s disciplinary action of pushing the broom bristles into the back of C1 knees, did not violate C1 personal rights. This poses a potential Health, Safety, or Personal Rights risk to persons in care.

    101216.3 (g) Teacher-Child Ratio: A teacher shall not be required to perform housekeeping or maintenance duties that prevent him/her from performing duties related to providing care and supervision to children. This requirement was not met as evidenced by: Based on interviews, teachers are responsible for cleanliness of the classroom. On August 12, 2024, an incident occurred due to S1 performing housekeeping duties rather than providing care and supervision. This poses a potential Health, Safety, or Personal Rights risk to persons in care.

  • INDOOR ACTIVITY SPACE FOR SCHOOL-AGE CHILDREN

    101538.3(b) Indoor Activity Space for School-Age Children: In combination programs, indoor activity space provided for school-age child care center children shall be physically separated from space provided for infant care and child care center children. This requirement is not met as evidenced by: Based on LPA observation, the Licensee did not ensure the school age children were separate from the preschool children, when C1 was in a preschool classroom with 5 other preschool children at 3:45pm. This poses an immediate risk to the health and safety of persons in care.
