What the inspector wrote

Licensing Program Analyst (LPA) Samuel Lopez arrived at the facility to conduct a visit to amend a report previously issued on 5/30/2024. Separately, on that day (5/30/2024), in meeting with the Licensee Charmaine Maligaspe, it was disclosed that the facility had a pipe burst and water leak in the infant classroom/modular. Licensee had attempted to submit the required documentation to the Department regarding this issue however, it was discovered that it was sent to the wrong email address. During the visit, LPA Lopez was also informed that due to the water leak, the classroom was closed for repairs, and infants were relocated to an empty classroom that is licensed for preschool children. The infants remained in the preschool classroom for two weeks. Based on the information gathered, the facility did not obtain permission/waiver from the Department, prior to moving or approval to move the infants into a classroom licensed and assigned to the preschool program. This is a violation of Title 22 regulations regarding Indoor Activity Space for Infants. See LIC809-D for cited deficiency. A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the Assistant Director Nancy Ortiz.

Based on document review and interview, the licensee did not comply with the section cited above. Infants were relocated to a preschool classroom without Department authorization/waiver. This poses/posed a potential health, safety, or personal rights risk to persons in care.
