What the inspector wrote
Licensee has requested for capacity increase to 12 children. Licensing Program Analyst (LPA) Kim Leung arrived at the facility to conduct a comprehensive inspection as part of a compliance review. LPA toured the facility, inside and out, records were reviewed and the following was observed and/or discussed:
Normal days and hours of operation are: Monday through Friday from 7am to 6pm
OFF-LIMIT AREAS INCLUDE: The master bedroom, the bedroom at the end of the hallway by the bathroom and the garage
The facility is operating within the licensed capacity and appropriate ratios

Fully-charged fire extinguishers rated 2A:10BC is available at this home. Smoke detector and carbon monoxide detector present and were tested by the licensee during this inspection and found to be in working condition.

All hazardous items indoor are stored inaccessible to children. There are poisonous plants (oleander and birds of paradise) in the backyard which have a fence at the bottom but the plants are stretching out and reachable to older children. Licensee agreed to trim the plants prior to receiving older preschool-age children in care. Pictures and written statement will be submitted.

No guns or weapons present as stated by the Licensee Tania Alamin and co-licensee Aron Cunningham. Licensee understands all guns, weapons and ammunition must be key-locked separately and made inaccessible per Title 22 Regulations

No bodies of water at this time. There are 2 water fountains, one in the front porch and the other one in the back yard. LPA observed no water in the fountains. There are sand bags in both fountains. Licensee understands all bodies of water including ponds, above ground pools & spas, in-ground pools & spas, and some fountains must be properly covered or fenced per Title 22 Regulations. The Department must be notified before and after installation of the above
types of bodies of water. In addition, all wading pools or similar product must be emptied immediately after use and stored in an upright position.

Clean, safe and age appropriate toys. The backyard is not completely fenced. Licensee and co-licensee understand that they have to be physically present with the children in the backyard when children are in the backyard.

Criminal record clearances are required prior to
all
adults living or working in a Family Child Care Home. A civil penalty of $100.00 per day the person has been present, may be assessed. Resident and/or staff records reviewed on 8/24/2021 indicate that all adults who require caregiver background checks have received all required clearances or exemptions.

Facility is not currently providing IMS

Prior to any IMS is provided an updated Plan of Operation that includes IMS must be submitted to the Department.

AB 1819 \342\200\223 Smoking prohibition on the premises of Family Child Care Homes, effective January 1, 2015 \342\200\223
This bans smoking tobacco in a home that is licensed as a family child care home, and in those areas of the family child care home where children are present. This change in law was based on demonstrated negative health effects of second and \342\200\234third hand\342\200\235 smoke on children. Third hand smoke generally refers to the residue from tobacco smoke that sticks to
surfaces after the secondhand smoke has cleared.

This information will be updated at least monthly on the website and will span the preceding five-year period.
- AB 2386 \342\200\223 Carbon Monoxide Detector Regulations, effective January 1, 2015 \342\200\223
In accordance with California Health and Safety Code Section 1975.543 - Every family day care home for children shall have one or more carbon monoxide detectors in the facility that meet the standards established in Chapter 8 (commencing with Section 13260) of Part 2 of Division 12. The department shall account for the presence of these detectors during inspections

- AB 2236 \342\200\223 Civil Penalties, effective July 1, 2015 \342\200\223
Enacts new civil penalties in cases where the Department determines that a violation of licensing standards resulted in the death or serious injury, or constitutes physical abuse of a child in care. The bill establishes an appeal procedure specific to these civil penalties. The bill also expands the scope of the Child Health and Safety Fund in order to assist parents in securing alternative child care when a Child Care Center or Family Child Care Home license has been suspended or revoked. These civil penalty amounts are scaled in relation to the total capacity of all of the licensee\342\200\231s facilities and not just the specific facility cited or limited to that facility type.
- SB 277 \342\200\223 Immunizations, Personal Beliefs Exemption, effective January 1, 2016 -
it eliminates the exemption from existing specified immunization requirements based upon personal beliefs, and only allows an exemption from future immunization requirements deemed appropriate by the State Department of Public Health or a medical professional for medical reasons.

In accordance with California Health and Safety Code Section 1596.866 - each family day care home licensee who provides care, shall have at least one hour of childhood nutrition training as part of the preventive health practices course or courses.
- SB792 \342\200\223 Immunization requirements for staff, volunteers, effective September 1, 2016 \342\200\223
In accordance with California Health and Safety Code Section 1597.622 (a)(1)- a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination or they may provide a statement declining the vaccination. If employees/volunteers are receiving the influenza vaccination, they must do so between August 1 and December 1 of each year.

For failing to correct a violation the civil penalty is increased to $100 per day for

violation until corrected; For failing to correct a repeated violation the civil penalty is increased to $250 immediately assessed , and $100 per day afterwards for

AB 1207 \342\200\223 Mandated Child Abuse Reporting: Child Day Care Personnel Training, beginning January 1, 2018 \342\200\223
In accordance with California Health and Safety Code Section 1596.8662 \342\200\223 requires all licensed providers, applicants,
directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. Applicants must meet requirements as a precondition to licensure. Existing licensees must meet requirements by March 30, 2018. New employees shall have 90 days to complete training as required. This training requirement may be directly met by using the Department\342\200\231s Office of Child Abuse Prevention (OCAP) online training modules. The OCAP modules are free of cost and available at:

and are provided in English and Spanish. If no training is made available in a required person\342\200\231s primary language then those persons shall be exempt from this requirement

- Once licensed, the Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days. If a serious violation is cited, a copy of the licensing report (LIC809/LIC9099) must also be posted for 30 days. A civil penalty of $100 per violation will be assessed for noncompliance.

A fire clearance has been obtained, Once the correction and the requirements have been completed, this application will be submitted for approval for a capacity of 12 children without the Property Owner/Landlord Consent or 14 children with the Property Owner/Landlord Consent. Exit interview was conducted with licensee Tanya Alamin.
During the exit interview, licensee
Tanya Alamin confirmed that there are no Registered Sex Offenders living in the facility and/or using the facility address for their mailing address.
A NOTICE OF SITE VISIT WAS ISSUED AND IS TO BE POSTED IN A PROMINENT LOCATION AT THE FACILITY FOR THE NEXT 30 DAYS. A copy of this report was provided to the licensee on this date and must be made available to the public upon request for the next 3 years.
