Documentation shall be maintained in the infant’s file and be available to the Department for review. Documentation shall include the following:(a.) Date. (b.) Infant’s name. (c.) Time of each 15-minute check.”

Infant Safe Sleep: (i) If an infant falls asleep before being placed in a crib or play yard, the provider shall move the infant to a crib or play yard as soon as possible. This was not met as evidenced by: LPA observed an infant asleep in a rocker. The infant also had a blanket on. This poses/posed an immediate risk to the health and safety of children in care.

ARTICLE 1. General Provisions and Definitions

(a) (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This was not met as evidenced by: S1 did not have Tdap on file for LPA's review. This poses a potential risk to the health and safety of children in care.

APPLICATION FOR INITIAL LICENSE

(9) Evidence of a current tuberculosis clearance, not more than one year prior to or seven days after initial presence in the home, for any adult in the home during the time that children are under care. This was not met as evidenced by: S1 and S2 did not have proof of a TB test in their files during review. This poses a potential health and safety risk to children in care.

ARTICLE 2. Administration of Child Day Care Licensing

(1) On/ before 03-30-18, a person who, on 01-01-18 is a licensed child day care provider, administrator/ employee of a licensed child day care facility shall complete the mandated reporter training (MRT) provided pursuant to paragraphs (2)&(3) of subdivision (a), &shall complete renewal MRT every two years following the date on which he or she completed the initial MRT.This requirement is not met as evidenced by: S1 did not have an updated MRT on file. S1's training expired in 2025.

(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (3) Where children are less than five years old are in care, stairs shall be fenced or barricaded.This requirement is not met as evidenced by: The gate at the foot of the stairs had a latch broken, to which LPA observed the family dog go up and down the stairs though. Since the daycare children have access to this area, and there were several children observed who were younger than 5 years old, this poses a potential risk to the health and safety of children in care.

Infant Safe Sleep: (b) Cribs or play yards shall be free from all loose articles and objects. This was not met as evidenced by: 1 infant was in a crib with a blanket underneath them, as well as an empty bottle next to their face. This poses/posed an immediate risk to the health and safety of children in care.

(h) Car seats shall only be used for transportation purposes and shall not be used for sleeping.This requirement is not met as evidenced by: Based on interview and record review including video footage, the licensee did not comply with the section cited above in that on at least 6 days it was documented that 1 infant slept in a car seat.

...A person...who is not exempt from fingerprinting shall obtain either a criminal record clearance or an exemption from disqualification... from the State Department of Social Services prior to employment, residence, or initial presence in the facility.This requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above in regards to 3 adults. 2 adults were working at the facility by providing care and supervision to children. 1 adult is living in the home, without fingerprint clearances. This poses an immediate health, safety or personal rights risk to persons in care.

REPORTING REQUIREMENTS

(b) The licensee shall report to the Department any of the events as specified in Health and Safety Code Sections 1597.467(b)(1)(A) through (b)(1)(C) that occur during the operation of the family child care home.This requirement is not met as evidenced by: Based on interview, the licensee did not comply with the section cited above in that the licensee did not report an unusual incident to the Department, which poses/posed a potential health, safety, and/or personal rights risk to persons in care.

(a) There shall be one crib or play yard for each infant who is unable to climb out of the crib or play yard.This requirement is not met as evidenced by:Based on interview, record review, and observations the licensee did not comply with the section cited above in that there are no cribs or play yards present in the facility. On at least 6 days it was documented that 2 infants that are not able to climb out of a crib or play yard, did not have a crib or play yard to sleep in and instead slept on rockers or car seats.

Based on record review and interview the licensee did not comply with the section cited above in that the last documented fire drill was conducted on 12/2024, which is more than 6 months from today's date 7/28/2025 which poses/posed a potential health, safety or personal rights risk to persons in care.

PERSONNEL RECORDS

Based on record review the licensee did not comply with the section cited above in that Staff 1 (S1), Staff 3 (S3), and Staff 4 (S4) did not have a copy of a renewed certificate of completion of Mandated Reporter Training. S3 & S4 also did not have a current copy of EMSA approved Pediatric CPR/First Aid card, which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on record review, the licensee did not comply with the section cited above in that Child 1 (C1) and Child 3 (C3) did not contain a completed LIC627 Consent for Emergency Medical Treatment form, which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on record review, the licensee did not comply with the section cited above in that Child 1 (C1) did not have documentation of 15 minute safe sleep checks available to review, which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on observation and interview, the licensee did not comply with the section cited above in that 1 play yard was present which did not contain a sheet that fits tightly on the mattress. Interview with licensees stated that their is a child present that uses the play yard as a sleeping area. This poses/posed a potential health, safety or personal rights risk to persons in care.

ADMISSION PROCEDURES AND PARENTAL AND AUTHORIZED

Based on record review, the licensee did not comply with the section cited above in that Child 1 (C1), Child 4 (C4), and Child 5 (C5) did not have the bottom portion of LIC995A kept in the child's file, which poses/posed a potential health, safety or personal rights risk to persons in care.
