What the inspector wrote

Licensing Program Analyst (LPA) arrived at the daycare on another matter. Present in the home were both licensees, 2 assistants and 9 children. During this visit, LPA observed violations of Title 22 Regulations which are cited on the LIC809D pages. LPA Aman Lama informed the licensee, Amber Gannon to provide a copy of this licensing report dated May 4, 2026 that documents any Type A citation(s) to parents/guardians of all children currently enrolled, or newly enrolled by the next business day or the next day the child(ren) is(are) in care. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification and kept on file for 12 months from the date of this report. See LIC809-D for cited deficiencies. LPA Aman Lama informed licensee Amber Gannon that this report dated May 4, 2026 document(s) (2) Type A citation(s) which shall be posted for 30 consecutive days as there is(are) immediate risk(s) to the health, safety, or personal rights of children in care. An LIC9224 was provided to licensee. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with licensee, Amber Gannon

What does Type A vs Type B mean?

Type A. Serious citation. Imminent or substantial risk to children. The regulator requires corrective action immediately and may impose a civil penalty.

Type B. Lower-severity citation. Corrective action required, no imminent risk. The regulator monitors compliance on the next visit.

    (9) Evidence of a current tuberculosis clearance, not more than one year prior to or seven days after initial presence in the home, for any adult in the home during the time that children are under care. This was not met as evidenced by: S1 and S2 did not have proof of a TB test in their files during review. This poses a potential health and safety risk to children in care.

    (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (3) Where children are less than five years old are in care, stairs shall be fenced or barricaded.This requirement is not met as evidenced by: The gate at the foot of the stairs had a latch broken, to which LPA observed the family dog go up and down the stairs though. Since the daycare children have access to this area, and there were several children observed who were younger than 5 years old, this poses a potential risk to the health and safety of children in care.

    Infant Safe Sleep: (b) Cribs or play yards shall be free from all loose articles and objects. This was not met as evidenced by: 1 infant was in a crib with a blanket underneath them, as well as an empty bottle next to their face. This poses/posed an immediate risk to the health and safety of children in care.

    INFANT SAFE SLEEP

    Infant Safe Sleep: (i) If an infant falls asleep before being placed in a crib or play yard, the provider shall move the infant to a crib or play yard as soon as possible. This was not met as evidenced by: LPA observed an infant asleep in a rocker. The infant also had a blanket on. This poses/posed an immediate risk to the health and safety of children in care.

  • ARTICLE 1. General Provisions and Definitions

    (a) (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year. This was not met as evidenced by: S1 did not have Tdap on file for LPA's review. This poses a potential risk to the health and safety of children in care.

    (1) On/ before 03-30-18, a person who, on 01-01-18 is a licensed child day care provider, administrator/ employee of a licensed child day care facility shall complete the mandated reporter training (MRT) provided pursuant to paragraphs (2)&(3) of subdivision (a), &shall complete renewal MRT every two years following the date on which he or she completed the initial MRT.This requirement is not met as evidenced by: S1 did not have an updated MRT on file. S1's training expired in 2025.
