Inspector’s narrative

What the inspector wrote

Licensing Program Analyst (LPA) Aman Lama arrived at the home on another matter. LPA met with the licensee, Alma Araiza. During the tour of the facility while LPA took census, LPA counted 9 children in care. 4 infants and 5 children under the age of 6, with no assistant present. According to Title 22 Regulations, Section 102416.5(e): "If no assistant provider is present at a Large Family Child Care Home, the licensee shall comply with the capacity requirements for a Small Family Child Care Home (FCCH) as specified in subsections (b) and (c)." Although the home is licensed as a Large Family Child Care Home, the licensee did not have a qualified assistant present, but had 9 children, which is a violation of Title 22 Regulations. Furthermore, LPA observed one child infant in a swing for approximately 11 minutes, and another for approximately XXXX minutes . Title 22 Regulations, Section 102425(i) states: "If an infant falls asleep before being placed in a crib or play yard, the provider shall move the infant to a crib or play yard as soon as possible." Although the licensee removed the child, it was upon inquiry with LPA that she did so. Licensee also stated that this infant will not sleep in the crib. The above Regulations are being cited on the attached LIC809D. LPA Aman Lama informed the licensee, Alma Araiza to provide a copy of this licensing report dated May 15, 2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled, or newly enrolled by the next business day or the next day the child(ren) is(are) in care. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification and kept on file for 12 months from the date of this report. LPA informed licensee, Alma Araiza that this report dated May 15, 2024 document(s) (1) Type A citation(s) which shall be posted for 30 consecutive days as there is(are) immediate risk(s) to the health, safety, or personal rights of children in care. During the exit interview, the licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Exit interview conducted and report was reviewed with the licensee, Alma Araiza.
