What the inspector wrote

The licensee stated the only times she leaves children unattended are when she briefly steps into the backyard to dispose of trash in the bins, but she never leaves her property. The licensee provided evidence showing she does not leave her property until 5:01 on the day before, and day of, trash days \342\200\224when no children are present\342\200\224to place the bins at the curb of a street, which is located away from the front of her home. However, the LPA received video evidence showing the licensee, on two separate occasions \342\200\223 one, leaving her property to take the trash bins to the street, and another, to bring them back on to her property. The LPA reviewed documentation from the dates of these recordings and confirmed children were present in the home during both instances, with no adult supervision. According to Regulation 102417(a): \342\200\234The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence\342\200\246.\342\200\235. Per the footage and documentation reviewed by LPA, this regulation was not met. Therefore, based on video evidence and documentation reviewed, the department has determined the preponderance of evidence standard has been met, and the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, are being cited on the attached LIC9099D. See LIC9099-D for deficiencies. An exit interview was conducted, and a copy of this report, Notice of Site (NOS) Visit form, and appeal rights were provided to licensee, Alma Araiza. Upon request, this report must be made available to the public for three years.

    OPERATION OF A FAMILY CHILD CARE HOME

    (a) The licensee shall be present in the home& ensure children in care are supervised at all times. When circumstances require licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This was not met as evidenced by: video footage showing licensee leaving the property during the time children were in care. This poses a potential risk to the health and safety of children.
