What the inspector wrote

An exit interview was conducted with Director Schwersensky and appeal rights (LIC 9058 1/16) were discussed. A copy of this report as well as a copy of the appeal rights were given to Ms. Schwersensky. LIC 9213 NOTICE OF SITE VISIT FORM IS REQUIRED TO BE POSTED FOR 30 DAYS. LPA observed the director post Notice of Site Visit. Based on interviews conducted by LPA and record reviews the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED, California Code of Regulations, Title 22, 101223(a)(2) is being cited on the attached LIC 9099D. An exit interview was conducted with director Schwersensky and Appeal Rights (LIC 9058 1/16) were discussed. Ms. Schwersensky’s signature on this form acknowledges receipt of these rights. LIC 9213 NOTICE OF SITE VISIT FORM IS REQUIRED TO BE POSTED FOR 30 DAYS. LPA observed the director post notice of site visit.

    101223(a)(2) Personal Rights: (a) The licensee shall ensure that each child is accorded the following personal rights:(2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by: Based on interviews with the director, staff and LPA observation, the director did not enforce the use of face masks/coverings on children and/or staff as required by state mandate in January 2022. This poses a potential health and safety risk to the children in care due to the COVID-19 pandemic.

    101212 Reporting Requirements:(d) Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. Also, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days...(1) Events reported shall include the following:(C) Any unusual incident... This requirement was not met as evidenced by: Based on LPA interview with the director, the director failed to notify Community Care Licensing of positive Covid-19 cases during the month January 2022. This poses a potential health and safety risk to children in care.
