Inspector’s narrative

What the inspector wrote

disclosed that Child #1 (C1) was enrolled in the daycare since February 9, 2022 and staff confirmed that several children have incurred injuries due to C1's behaviors. Confidential interviews also disclosed to LPA that the aggressive child is larger and older than the other children in the class and has been observed hitting, pushing and being verbally aggressive towards other children in care. Confidential interviews and records review revealed to LPA that C1 does have a Classroom Safety Plan and Positive Behavior Support Planning chart on file, however, the therapist managing the support plan is no longer employed by the daycare and some staff were not included and/or part of the execution of the plan. Based on information gathered, the preponderance of evidence has been met, and the allegation that children are being injured by another child while in care is SUBSTANTIATED. The facility is being cited for violation of Title 22 Section 101223.(a)(1) Personal Rights which posed a potential health, safety and/or personal rights risk to children in care. See LIC 9099-D for cited deficiencies. An exit interview was conducted and a copy of this report and appeal rights were discussed and provided to Assistant Director. A notice of site visit was also provided and Assistant Director reminded the notice must remain posted for 30 days.

    101238(a) Building and Grounds (a) The childcare center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement was not met as evidenced by: Based on records review and confidential interviews, the CCC’s roof had a leak causing the tile(s)in Room #2 to bulge, leak and be discolored. The CCC continued to utilize the room and have children and visitors present.

  • FIXTURES, FURNITURE, EQUIPMENT AND SUPPLIES

    101239( e)(4) Fixtures, Furniture, Equipment and Supplies ( e) Faucets used by children for personal care shall deliver hot water. (4) All toilets, handwashing and bathing facilities shall be maintained in safe and sanitary operating condition...conveniences shall be provided...in centers that serve children with physical disabilities. This requirement was not met as evidenced by: Based on observation and confidential interview with director it was confirmed that toilet closest to the wall in the bathroom between Rooms #4 & #2 does not flush.

  • PERSONAL RIGHTS

    101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement was not met as evidenced by: Based on information gathered, children were injured by C1 while in care which poses a potential health, safety risk and/or personal rights risk to children in care.
