What the inspector wrote

Regarding the allegation, Children sustaining unexplained injuries due to Inappropriate interaction. During interviews on 03/05/25 and 03/06/25, LPA was unable to corroborate that unexplained injuries have occurred to any children in care. During the investigation, LPA found evidence of ouch incident reports provided to parent/guardian and the policy which the CCC established, being followed when a child had sustained and incident/injury in care. The CCC provided LPA with copies of the recent ouch/incident reports for various recent incidents and evidence of referrals and resources used for families and/or staff for children in care as preventative and supportive measures to aid in behavior and classroom management for children in care. Therefore, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED. Regarding the allegation, Inadequate supervision being provided to children. During the visit on 03/05/2025, LPA made observations of each classroom which also included the areas children use to wash hands/use restroom and found that at all times a staff was not only present but at least one staff was facing the less frequented restroom areas at all times as well as each room had a door alarm/bell/chime that would sound if the door was opened. Additionally, LPA did observe children notifying the teacher when they were going to use the restroom and staff walking over to visually observe children in both the classroom and bathroom and/ or additional staff being called to assist to children inside for hand washing/restroom use. LPA also observed staff allowing children space to calm when upset but were supervising the children from additional feet away. Therefore, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED. Regarding the allegation, Incidents not reported to authorized representatives. Evidence collected on 03/05/25 and 03/06/25, supported that the family/guardians receive a written report, signed, incident report for injuries/ouches sustained and evidence of additional communication of documented time and date stamped phone call to the emergency contact on file in more serious incidents such as an injury from the neck or above, or broken skin was also shared to LPA. The CCC also provided the the internal policy and procedure that they have implemented for parent and /or staff concerns and or complaints and had no evidence of issues of unreported incidents or injuries brought to their attention. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED. A copy of this report, appeal rights and Notice of Site Visit were provided to Director Elizabeth Arroyo was reminded that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.
