What the inspector wrote

Confidential Interviews also revealed that there have been more than 5 incidents that required the need for the Director to address use of cell phones by staff members both inside the classroom and on the outdoor playground, specifically during crucial times of supervision. Additionally, through the confidential interviews and evidence gathered it is determined that there have been prior incidents within this school year of enrolled children dropped from the after-school bus, walking alone and without supervision, through the parking lot to the CCC, due to lack of staffing. Based on LPA’s observation, interviews and documents gathered, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. A Type A Deficiency is being issued due to the lack of Responsibility for Providing Care and Supervision. A notice of site visit was given and licensee understands this must remain posted for 30 days. An exit interview was conducted, and this report was reviewed with facility representative Briana Griego. Appeal rights were discussed and provided during the exit interview with Facility representative, Briana Griego. In addition, pertinent interviews with Staff were conducted, and the allegation was denied, as they had not observed any teachers yelling at any of the children in care. LPA did not find a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED. Regarding the allegation Staff do not ensure that facility is maintained clean. On 04/02/24 and 04/09/24, LPA Gerth conducted a tour of the daycare, including, but not limited to the restrooms and kitchen area and LPA noted that the CCC was cleaned appropriately and did not appear to be dirty. Furthermore, confidential interviews and relevant files obtained, revealed that cleaning charts, rotating disinfecting and sanitizing schedules and weekly use of an outside cleaning company, are in place at the CCC to ensure appropriate cleaning is completed regularly. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED. Regarding the allegation that staff do not ensure that food served to children is of the quality necessary, LPA Gerth observed the CCC to serve food of appropriate quality and quantity, based on Title 22 regulations. Additionally, interviews, relevant files obtained, and observations made by LPA, revealed that an outside catering service delivers food daily to the CCC for lunch. Additionally, on both 04/02/24 and 04/09/24, LPA observed posted menus describing breakfast and snacks served, which reflected the same food observed in kitchen. All food was appropriately packaged, labeled and stored. In addition, per interviews conducted, LPA was unable to corroborate allegation that the food served is not of the quality necessary. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED. A copy of this report, appeal rights and Notice of Site Visit were provided to Facility Representative Briana Griego and was reminded that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.

This requirement was not met as evidenced by: LPA confirmed that school age and preschool children were being commingled, daily.

    101215.1(b)(1) Child Care Center Directors Qualifications and Duties All childcare centers shall have a director. Only one director shall be required in a combination center. This requirement was not met as evidenced by: LPA confirmed that the daycare did not have a full time director and would rotate duties between 3 individuals; one of which was the designated director for a different location, as well as an administrative assistant and a regional director.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229(a)(1) The licensee shall provide care and supervision as necessary to meet the children’s needs (1) no child shall be left without the supervision of a teacher at any time...supervision shall include visual observation. This requirement was not met as evidenced by: Based on interviews, observations and evidence gathered it was revealed that staff have used cell phones during crucial times of supervision as well as children walking alone from the after-school bus to the CCC. This poses an immediate health and safety risk to the children in care.
