RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229 Responsibility for Providing Care and Supervision(a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation.This requirement was not met as evidenced by: Based on interviews and record review, C1 left the facility unattended for approximately 3-7 minutes, therefore the licensee did not comply with the section cited above which posed an immediate health, safety or personal rights risk to persons in care.

DISASTER AND MASS CASUALTY PLAN

Based on interview and record review, the licensee did not comply with the section cited above in that there was no record of any completed disaster drills which poses a potential health, safety or personal rights risk to persons in care.

Based on interview and record review, the licensee did not comply with the section cited above in 5 out of 5 children files reviewed did not have the LIC9224 on file regarding the noncompliance conference which poses a potential health, safety or personal rights risk to persons in care.

OUTDOOR ACTIVITY SPACE

Based on observation and record review, the licensee did not comply with the section cited above in that there is a slide and high climbing equipment that does not have anything to absorb the fall which poses a potential health, safety or personal rights risk to persons in care.

OUTDOOR ACTIVITY SPACE

Based on observation, the licensee did not comply with the section cited above in that there is a tree stump located in the middle of the outside play ground that is a hazard which poses a potential health, safety or personal rights risk to persons in care.

Based on observation, the licensee did not comply with the section cited above in that there was food located in a shelf that is used to store items for the classroom which poses a potential health, safety or personal rights risk to persons in care.

STORAGE SPACE

Based on observation, the licensee did not comply with the section cited above in that there were several cleaning items labeled "keep out of the reach of children" accessible to chidlren in both classrooms which poses a potential health, safety or personal rights risk to persons in care.

Based on observation the licensee did not comply with the section cited above in the sand box is not filled with sand exposing the plastic layer underneath which poses a potential health, safety or personal rights risk to persons in care.

CRIMINAL RECORD CLEARANCE

101170(e)(1) Criminal Record Clearance: All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility:(1) Obtain a California clearance or a criminal record exemption as required by the Department or..This requirement was not being met as evidenced by: Based on record review and interview, the licensee did not comply with the section cited above in that S1 was present and working 6 days at the facility and had not received background clearances or exemptions which poses an immediate health, safety or personal rights risk to persons in care.

LIMITATIONS ON CAPACITY

101161(a) Limitations on Capacity, A Licensee shall not operate a childcare center beyond the conditions and limitation specified on the license, including capacity limitation. This requirement was not met as evidenced by: LPA confirmed that school age and preschool children were being commingled, daily.

101215.1(b)(1) Child Care Center Directors Qualifications and Duties All childcare centers shall have a director. Only one director shall be required in a combination center. This requirement was not met as evidenced by: LPA confirmed that the daycare did not have a full time director and would rotate duties between 3 individuals; one of which was the designated director for a different location, as well as an administrative assistant and a regional director.

This requirement was not met as evidenced by: Based on interviews, observations and evidence gathered it was revealed that staff have used cell phones during crucial times of supervision as well as children walking alone from the after-school bus to the CCC. This poses an immediate health and safety risk to the children in care.

Fire Clearance:All child care centers shall secure and maintain a fire clearance approved by the city or county fire department, the district providing fire protection services, or the State Fire Marshal. This requirement was not met as evidenced by:LPA confirmed that a trailor located in the school premises was being used by the school-age children and did not have an appoved fire clearance.

ALTERATIONS TO EXISTING BUILDINGS OR NEW FACILITIES

Alterations to Existing Building and Grounds or New Facilities:Prior to construction or alterations, the licensee shall notify the dept of the proposed changes. This requirement was not met as evidenced by: LPA observed that there was a classroom being renovated with exposed hazards and was being used by school age children.

Health Related Services:All prescription and nonprescription medications shall be centrally stored.This requirement was not met as evidenced by: During review of childrens records , LPA noted that children with allergies enrolled, however, 1 EpiPen was expired and the other had not been obtained from the parent and was not on site.

Buildings and Grounds:All children shall be protected against hazards within the center.This requirement was not met as evidenced by: During tour of facility, LPA observed that a classroom was being used that had electrical outlets that did not have a cover and wiring was exposed, exposed plumbing pipes and broken toys.

ARTICLE 2. Administration of Child Day Care Licensing

Child Roster (Health & Safety):All childcare facilities who provide care to children are required to maintain a current roster.This requirement wa not met as evidenced by: During visit, LPA reviewed the roster on file and observed that it was incomplete and did not include all children enrolled.

PERSONNEL REQUIREMENTS

Based on LPA Wilburn's record review, the licensee did not comply with the section cited above in 2 out of 4 Staff, Staff 1 (S1) and Staff #4(S4), do not have proof of a health screening available for review at time of visit, which poses/posed a potential health, safety or personal rights risk to persons in care.
