What the inspector wrote

Licensing Program Analyst (LPA) Kelly Gerth conducted a Case Management visit on this date to address an issue separate from the complaint investigation (Complaint Control # 10-CC-20240326090747) conducted. During visit conducted on this date, LPA observed that the facility Director/Administrator was not on site and noted that morning, the daycare was commingling school age and preschool children. LPA arrived at the facility at approximately 9:13 a.m. and was informed by staff that they could not greet her at the door because they would be out of ratio. Further questioning revealed that the facility does not have an assigned Director, however, 3 different facility representatives have been the acting director since April 9, 2024 until present. A Regional Director, Administrative Assistant and Director from another Learning Jungle location have rotated days and times. Beginning the last week of April 2024, The Administrative Assistant and Director, from a different location, have shared a split, rotating schedule of 2 days per week/3 days per week at this CCC. LPA Gerth observed current sign in and out sheets reflecting school age children and preschool children playing together in the same classroom and were not physically separated as required, per Title 22. See LIC809 D for cited deficiencies of the California Code of Regulations, Title 22, Div. 12. An exit interview was conducted. The appeal rights were discussed and provided along with a copy of this report to Facility Representative Briana Griego, on this date. A Notice of Site Visit was posted.

    101161(a) Limitations on Capacity, A Licensee shall not operate a childcare center beyond the conditions and limitation specified on the license, including capacity limitation. This requirement was not met as evidenced by: LPA confirmed that school age and preschool children were being commingled, daily.

    101215.1(b)(1) Child Care Center Directors Qualifications and Duties All childcare centers shall have a director. Only one director shall be required in a combination center. This requirement was not met as evidenced by: LPA confirmed that the daycare did not have a full time director and would rotate duties between 3 individuals; one of which was the designated director for a different location, as well as an administrative assistant and a regional director.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229(a)(1) The licensee shall provide care and supervision as necessary to meet the children’s needs (1) no child shall be left without the supervision of a teacher at any time...supervision shall include visual observation. This requirement was not met as evidenced by: Based on interviews, observations and evidence gathered it was revealed that staff have used cell phones during crucial times of supervision as well as children walking alone from the after-school bus to the CCC. This poses an immediate health and safety risk to the children in care.
