What the inspector wrote

On 04/30/25, Licensing Program Analysts (LPA) Kelli Waters, conducted a subsequent unannounced Case Management visit to follow up on Unusual Incident Report (UIR) that was submitted to Community Care Licensing (CCLD) on 03/04/25, regarding an incident that took place on 03/03/25. During the visit site Director, Nialea Ortega-Guachena, was not present. LPA met with Regional Operations Coordinator, Jennifer Ruiz-Quintero and informed her of the reason for the visit and findings follow the investigation into the incident. LPA conducted a facility inspection, took census of the facility, and conducted an interview. On 03/04/25, the Director reported the following to CCLD; on 03/03/25, C1 left the Learning Jungle (CCC) unattended and was found by a community member and brought back to the facility. During the investigation, LPA Waters inspected the facility, conducted interviews, reviewed records, and contacted San Diego Sheriff Department to obtain the incident report. Interviews, witness statements and record review revealed that C1 was able to leave the CCC due to lack of supervision, crossed Valley Center Road and was absent for approximately 3-7 minutes from the CCC. According to interviews, staff became aware of C1’s disappearance only after they were returned to the facility by a community member. CCC took disciplinary action against staff involved and reviewed supervision training with staff. CCC is being issued a TYPE A deficiency for Responsibility for Providing Care and Supervision. In addition, during a previous Case Management visit on 05/07/24, CCC was cited for lack of supervision. Due to a repeat violation of regulation 101229(a)(1) within one year, an immediate civil penalty of $1000 will be assessed today. See 809D and LIC421IM for details. An exit interview was conducted, a copy of this report, and appeal rights. Exit interview conducted and report was reviewed with the Director Nialea Ortega-Guachena. Appeal rights were provided and a Notice of Site Visit was given and must be posted for 30 days.

Supervision shall include visual observation.This requirement was not met as evidenced by: Based on interviews and record review, C1 left the facility unattended for approximately 3-7 minutes, therefore the licensee did not comply with the section cited above which posed an immediate health, safety or personal rights risk to persons in care.
