What the inspector wrote

On September 19, 2024, at 2:16PM, Licensing Program Analyst (LPA), William Chancellor arrived unannounced to Childrens Choice Academy: Vista (CCC) and met with Shannon Spencer, Regional Director to discuss the investigative findings of the allegation listed above. On August 5, 2024, at 12 noon, LPA conducted a tour, took census of the CCC and gathered evidence relevant to the investigation. During the investigation, LPA made observations and conducted confidential interviews with five staff (S1-S5). On August 5, 2024, a complaint was received alleging that due to a lack of staff supervision, an infant sustained an injury while in care. Three of three interviews with staff present during the incident, corroborated that C1 was crawling and while holding a toy, lost balance and fell forward bumping their head on the floor. CCC notified parent through a private app, however there was a lapse in calling the parent. Interviews and record review also confirmed CCC staff were in ratio on the date of the incident with three staff and six children. Based on interviews and record review, LPA is unable to corroborate the allegation that lack of staff supervision resulted in infant sustaining injury while in care This allegation may have occurred; however, it is not supported, or proven by evidence. Therefore, the above allegation is unsubstantiated. An exit interview was conducted, a copy of this report, and appeal rights, along with a Notice of Site Visit was handed to Shannon Spencer. Notice of Site Visit must remain posted for 30 consecutive days in a prominent place, visible to families and caregivers.

    Limitations on Capacity:(a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met as evidenced by: Based on interview and record review, school age child was commingling with infant age children on July 29, 2024. CCC does not have a school-age license and school age child was left unattended by parent.

    Indoor Activity Space for Infants: (b) Indoor activity space for infants shall be physically separate from space used by children in the child care center and school-age child care center components. This requirement was not met as evidenced by: Based on interviews and record review, commingling occurred when previous staff school age children were left unattended in the infant classroom and playground on two separate occasions with daycare children present.

    Based on interview and record review, the licensee did not comply with the section cited above in two out of six child files audited. Child 3 and 5 were both missing current immunization records on file, prior to admission to center. Which poses a potential health, safety or personal rights risk to persons in care.

Where Child 5 who started in March, 2024 did not have a physician report available for review during inspection. Which poses a potential health, safety or personal rights risk to persons in care.
