What the inspector wrote

On 10/18/24, at 9:00 AM, Licensing Program Analyst (LPA) Adrian Castellon conducted an inspection to conclude the complaint investigation regarding the above allegations. LPA advised assistant director Alma Eseller of the purpose of the inspection and was granted facility entry. It was alleged that Facility staff are operating out of ratio and that Licensee allows unqualified staff to work at facility During the course of the investigation, two unannounced inspections were conducted. Interviews were conducted with reporting party, staff and day-care parents. Based on the records review and staff admission, the allegations are substantiated. On 7/29/24, per Ratio Sheets and statement, staff member was in care for more than 12 children when they were supposed to be napping, but were not. Facility staff admits to working in the preschool classrooms without the required units. As such, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. Violations of the California Code of Regulations, Tittle 22, are being cited on the attached LIC9099D. Two Type B citation issued. An exit interview was conducted with licensee and a copy of this report, Appeal Rights and Notice of Site Visit were provided.

  • TEACHER-CHILD RATIO

    101216.3 Teacher-Child Ratio: (a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. Per ratio sheets dated 7/29/24 and staff statement, staff member was left alone with 21 children as children awoke from nap. This may pose a threat to the health and safety of children in care.

    101216.2 Teacher Aide Qualifications and Duties: (d) An aide assisting a fully qualified teacher (as specified in Section 101216.1(c)) in the supervision of up to 18 preschool-age children, pursuant to Section 101216.3 shall meet the following requirements: (1) Completion of six postsecondary semester or equivalent quarter units in early childhood education or child development. This requirement was not met as facility staff worked as an aide on more than one occasion, per own admission, without required units. This may pose a threat to the health and safety of children in care.
