RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

(a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation.This requirement is not met as evidenced by: Based on observations and interviews, the facility did not comply with the section cited above. On 08/19/2025, C2 bit C1 on the right cheek during outdoor play, and staff were not positioned to observe or prevent the incident, posing an immediate risk to the health, safety, or personal rights of children in care.

OUTDOOR ACTIVITY SPACE

Based on observation and interview, the acting director did not comply with the section cited above in that the LPA observed a hole around the sprinkler located in the two's playground against the east fence which could be a potential hazard for children and staff which poses a potential health, safety or personal rights risk to persons in care.

TEACHER-CHILD RATIO

101216.3 Teacher-Child Ratio: (a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. Per ratio sheets dated 7/29/24 and staff statement, staff member was left alone with 21 children as children awoke from nap. This may pose a threat to the health and safety of children in care.

101216.2 Teacher Aide Qualifications and Duties: (d) An aide assisting a fully qualified teacher (as specified in Section 101216.1(c)) in the supervision of up to 18 preschool-age children, pursuant to Section 101216.3 shall meet the following requirements: (1) Completion of six postsecondary semester or equivalent quarter units in early childhood education or child development. This requirement was not met as facility staff worked as an aide on more than one occasion, per own admission, without required units. This may pose a threat to the health and safety of children in care.

§1596.956 Child day care centers serving infants; optional toddler program; departmental guidelines and regulations: (a) The department shall develop guidelines... to create a special program component for children between 18 months to three years of age. The optional toddler program shall be subject to the following basic conditions: (4) A ratio of six children to each teacher shall be maintained for all children in attendance at the toddler program. This requirement was not met as evidenced by LPA observation, face to name sheets and interviews. This may pose a threat to the health and safety of children in care.

PERSONAL RIGHTS

101223 Personal Rights: 101223 Personal Rights (a)The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidence by child being injured and not receiving first aid. This could pose a threat to the health and safety of children in care.

Supervision shall include visual observation. This requirement was not met as evidence by child being injured due to a lack of required supervision. This could pose a threat to the health and safety of children in care.

PERSONAL RIGHTS

101223 Personal Rights: (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by: child in care was left in soiled diaper for an extended period of time which resulted in a diaper rash.

REPORTING REQUIREMENTS

101212 Reporting Requirements (d)...a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours...(1)Events reported shall include the following:(E) Epidemic outbreaks.This requirement was not met as evidenced by: Based on interviews and record review, the Licensee did not comply with the section cited above as there was an epidemic outbreak and was not reported in a timely manner. This poses a potential health, safety or personal rights risk to persons in care.

PERSONAL RIGHTS

The licensee shall ensure that each child is accorded the following personal rights: To be free from corporal or unusual punishment, infliction of pain, humiliation..., ridicule...mental abuse…including but not limited to: interference with functions of daily living including eating, sleeping…or…physical functioning. This requirement was not met as evidenced by: Based on review of video evidence, and interviews, the Department has determined that on 02/17/2021, a staff handled two (2) children in a rough manor during nap time. This poses an Immediate Health and Safety risk to the children in care.

TEACHER-CHILD RATIO

101216.3 Teacher-Child Ratio (a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance…The requirement was not met as evidenced by: Based on interviews and record reviews, the licensee had various staff members watching more than twelve preschool children by themselves at different times in the month of April which poses an immediate Health and Safety risk to the children in care.
