Inspector’s narrative

What the inspector wrote

dispenser, to wash C1’s hands. The sink with the instant hot water faucet, also contained a traditional water faucet, and according to staff and parents interviewed, is one (1) of two (2) sinks regularly used by, both, staff and parents to wash children’s hands in the classroom. According to C1’s father, the temperature of the water dispensed from the faucet was measured at 184 degrees Fahrenheit (F) on 11/27/24. On 12/05/24, during facility inspection LPAs measured the temperature of the water dispensed from the faucet to be 148.8 degrees F. According to the instant hot water dispenser’s owner’s manual, the unit has the capacity to heat water to, at least, 200 degrees F, potentially up to boiling and includes a scalding hazard, severe burn warning. Based on staff and parents interviewed, the faucet in question was not prominently identified by warning signs even though the temperature of the hot water delivered exceeded 125 degrees F. Based on LPAs’ observations, interviews which were conducted, and records reviewed, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. Per California Code of Regulations, (Title 22, Division 12 & Chapter 3) one (1) Type A and one (1) Type B citations are being cited on the attached LIC 9099-D. Exit interview conducted and report was reviewed with the Director, Kendra Dedron and Assistant Director, Alma Eseller. A Notice of Site visit was given and must remain posted for 30 days.

    101239 Fixtures, Furniture, Equipment and Supplies. (e) Faucets used by children for personal care shall deliver hot water. (1) Hot water temperature controls shall be maintained to automatically regulate temperature of hot water delivered to plumbing fixtures used by children to attain a hot water temperature of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C).This requirement was not met as evidenced by: Based on interviews conducted and records reviewed, the licensee did not comply with the above regulation, as Classroom #1 contains a sink with two (2) water dispensing features, including a faucet used by staff and parents to wash children’s hands and one (1) with an instant hot water faucet spout used by staff for children’s personal care, which delivered water in excess of 120 degrees F resulting in an injury to C1, which poses an immediate Health & Safety risk to children in care.
