101239 Fixtures, Furniture, Equipment and Supplies. (e) Faucets used by children for personal care shall deliver hot water. (1) Hot water temperature controls shall be maintained to automatically regulate temperature of hot water delivered to plumbing fixtures used by children to attain a hot water temperature of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C).This requirement was not met as evidenced by: Based on interviews conducted and records reviewed, the licensee did not comply with the above regulation, as Classroom #1 contains a sink with two (2) water dispensing features, including a faucet used by staff and parents to wash children’s hands and one (1) with an instant hot water faucet spout used by staff for children’s personal care, which delivered water in excess of 120 degrees F resulting in an injury to C1, which poses an immediate Health & Safety risk to children in care.

(2) Taps delivering water at 125 degrees F (51.6 degrees C) or above shall be prominently identified by warning signs.This requirement was not met as evidenced by: Based on interviews conducted, the licensee did not comply with the above regulation, as a faucet in Classroom #1 delivering hot water in excess of at least, 148 degrees F was not prominently identified by warning signs even though the temperature of the water exceeded 125 degrees F, which poses a potential Health & Safety risk to children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION FOR INFANTS

Responsibility for Providing Care and Supervision for Infants: (a) In addition to Section 101229, the following shall apply:(1) Each infant shall be constantly supervised and under direct visual observation and supervision by a staff person at all times. This requirement was not met as evidenced by staff not being able to state that they witnessed child fall while in care. This may pose a threat to the health and safety of children in care.

PERSONAL RIGHTS

101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced by: Based on interviews conducted and self reported incident, infant was fed wrong bottle of breast milk and then another infant was fed the remainder of that bottle, which poses a potential health, safety or personal rights risk to persons in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION FOR INFANTS

STAFF-INFANT RATIO

101416.5 Staff-Infant Ratio (b) There shall be a ratio of one teacher for every four infants in attendance. The requirement was not met as evidenced by: Based on interviews and record reviews, the licensee had various staff members watching more than four infants by themselves at different times in the month of April which poses an immediate Health and Safety risk to the children in care.

INDOOR ACTIVITY SPACE FOR INFANTS

101438.3 Indoor Activity Space for Infants (b) Indoor activity space for infants shall be physically separate from space used by children in the child care center and school-age child care center components. The requirement was not met as evidenced by: Based on interviews and record reviews, in the month of April the licensee had children from the toddler option program commingled with children from the infant program during limited parts of the day which poses an immediate Health and Safety risk to children in care.
