During the month of July 2021, between the approximate hours of 3:30pm to 9:30pm, staff exceeded the licensed maximum capacity on twenty-two (22) separate occasions by providing care to fifteen (15) to twenty (20) day care children at one time. The licensee has acknowledged being over capacity. Based on the licensee\342\200\231s admission, interviews and review of supportive documentation, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Deficiencies are cited per California Code of Regulations, Title 22, Division 6 on the attached 9099D. An exit interview was conducted and report was reviewed with the licensee, Qays Gorgees. LPA Jennifer Lott informed licensee, Qays Gorgees that this report dated 12/30/21 document(s) one (1) Type A citation(s) which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA Jennifer Lott informed the licensee, Qays Gorgees , to provide a copy of this licensing report dated 12/30/21, that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. The Notice of Site Visit (LIC 9213) was provided to Licensee, Gorgees which is to be posted at the facility for 30 days. LPA observed form LIC 9213 posted. An exit interview was conducted with Licensee, Qays Gorgees. Appeal and licensee rights (LIC 9098 01/16) along with a copy of this report was provided. Licensee signature below confirms receipt of these rights and documents.
