What the inspector wrote

On 09/07/2021 at 10:40 a.m., Licensing Program Analyst (LPA) Michelle Hood arrived to conduct an unannounced inspection to deliver complaint findings. Upon arrival, LPA met with licensee to discuss final findings on allegation provider spanks day care children while in care. LPA interviewed one (1) child in care at the time of inspection. During the course of the investigation, interviews were conducted with the reporting party, daycare parents, daycare child, staff and licensee. Daycare parents, daycare child and staff stated they have not observed licensee or other staff spanking children in care. Licensee denies allegation. Due to conflicting statements obtained during the course of the investigation, the above allegation is found to be UNSUBSTANTIATED meaning that although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred. Licensee was provided appeal rights (LIC9058 01/16) and their signature on this form acknowledges receipt of these rights. Provided Notice of Site Visit. LPA observed that LIC 9213 was posted. No deficiencies cited. An exit interview was conducted with the licensee.

This requirement is not met as evidenced by: Licensee’s admission, sometime between April 2021 & June 2021, licensee raised concerns with the responsible party regarding scratches and bite marks on three daycare children in care. Licensee failed to report suspected neglect/abuse to the Dept. This is a potential health & safety risk to children in care.
