What the inspector wrote

On 01/05/2026 at 1:00 P.M., Licensing Program Analyst (LPA) Julieta Abrego conducted an unannounced Annual Required Inspection, which also included a review for the licensee's request for an increase of capacity, and met with Licensee Leslie Osorio, LPA disclosed the purpose of the inspection and was granted entry into the facility by the Licensee. There were two (2) children present in the facility during this inspection and one staff. The licensee accompanied LPA inside and outside of the facility during the inspection. The off-limits areas are made inaccessible using door locks, door knobs, and safety gates. Per the licensee the operating hours are Monday through Sunday 23 hours a day. Licensee submitted an application (LIC 279) requesting a capacity increase. The Fire Safety Inspection Request (STD 850) was approved by the local fire marshal on 12/11/2025 for fourteen (14) children. The Licensee has provided proof of control of property and LIC 9151 Landlord/Owner. The licensee submitted proof of landlord consent and is approved to operate with a maximum capacity of 14 children. Licensee will use the following areas for childcare: living room, family room, kitchen, bedroom #1, bedroom #2, bathroom #1 and backyard. Licensee uses the backyard for outdoor play and is fully fenced. There are two sets of stairs: one leading to the upstairs area and the other leading to the family room. The stairs are made inaccessible by a safety gate. The off-limits area are made inaccessible via safety gates and doorknob covers. There are no bodies of water observed during the time of inspection. There are enough age-appropriate toys, games, and books available. The home was clean and orderly during the inspection. The fire extinguisher is rated 3-A:40; B:C, smoke alarm, and carbon monoxide detector are operational. The is a working telephone in the home and all required forms are posted. The licensee stated there are no weapons or firearms in the home. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for and removing any recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. The applicant understands they must physically check on sleeping infants every 15 minutes. An Individual Infant Sleeping Plan [LIC 9227 (3/20)] will be maintained for each infant up to 12 months of age and shall be available to the Department for review. The licensee understands infants up to 12 months of age must be placed on their backs for sleeping. LPA discussed the following: Reporting suspected child abuse & neglect, maintaining children\342\200\231s records according to regulation, and post required forms. The licensee was reminded corporal punishment, smoking, exersaucers, bouncy seats, walkers, jumpers, and/or similar equipment are not allowed in daycare. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. During the exit interview, the Licensee Lesie Osorio, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. LPA reviewed children's files and emergency drill logs. The licensee provided LPA a copy of the facility roster. The last fire/disaster drill was conducted on 11/06/2025. Pediatric CPR and First Aid certification expire 03/2026. The Mandated Reporter training was completed on 04/02/2024. LPA discussed with the licensee always maintaining supervision of daycare children. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22- 02-CCP. The Licensee and LPA reviewed the Ratio/Capacity Worksheet for a large family childcare home. The Licensee acknowledged that if no assistant provider is present at a Large Family Child Care Home, then the Licensee shall comply with the capacity requirements for a Small Family Child Care Home. Licensee acknowledges that their assistant's records will be maintained in the daycare for review by the Department. The maximum capacity for a large family childcare home: Maximum capacity: 12 children, with no more than 4 infants, or max. 14 children (with a qualified assistant) with no more than 3 infants, 1 child enrolled in kindergarten or elementary school and 1 child at least age 6 including children under age 10 who live in the licensee's home. When there are no Qualified Assistants, 14 years of age or present, the capacity reverts to the requirements for a Small Family Child Care. Licensure for a capacity of fourteen (14) children is approved effective today 01/05/2026. A new license will be generated and mailed to the provider. An exit interview was conducted with licensee Leslie Osorio. A copy of the licensing report and appeal rights were provided to the licensee. A notice of site visit was provided and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
