What the inspector wrote

On 07/08/2025 at 12:30PM Licensing Program Analyst (LPA) Hanna Lucas was conducting an inspection concerning another matter at the facility. There were 86 children and 13 staff at the facility today. LPA explained to the Assistant Principal, Rocio Sainz, that the facility must report any unusual incidents that threaten the physical or emotional health or safety of any child to the Department, via telephone or fax by the next working day. The incident that occurred in April 2025, where a staff member(S1) was smoking on day care premises, resulting in a TYPE A deficiency, was not reported to the Department. Therefore, a TYPE B deficiency will be issued on the LIC809D for failure to report. An exit interview was conducted with the Assistant Principal, Rocio Sainz. Appeal rights were provided and discussed. A Notice of Site Visit was provided and must remain posted in public view for 30 days.

  • TEACHER AIDE QUALIFICATIONS AND DUTIES

    101216.2(e) Teacher Aide Qualifications and Duties: An aide shall work only under the direct supervision of a teacher. This requirement was not met as evidenced by: Based on file review and staff interviews, it was found that (S1) and (S2) supervised children alone at various times, in multiple classrooms, without the direct supervision of a fully qualified teacher. This poses/posed a potential health, safety or personal rights risk to the children in care.

    Smoking Prohibition - Smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). This requirement was not met as evidenced by: Based on a file review and staff interviews, it was found that staff member(S1) was smoking inside the day care facility, which posed an immediate Health, Safety, or Personal Rights risk to the children in care.

    101212(d)(1)(c) Reporting Requirements: Upon the occurrence, during the operation of the child care center…(d)(1)…a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following:(C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not met as: Based on file review, staff interviews, and information gathered during another matter, the facility did not report to the Department about an incident that occurred in April 2025, that involved a staff smoking on day care premises.
