TEACHER AIDE QUALIFICATIONS AND DUTIES

101216.2(e) Teacher Aide Qualifications and Duties: An aide shall work only under the direct supervision of a teacher. This requirement was not met as evidenced by: Based on file review and staff interviews, it was found that (S1) and (S2) supervised children alone at various times, in multiple classrooms, without the direct supervision of a fully qualified teacher. This poses/posed a potential health, safety or personal rights risk to the children in care.

Smoking Prohibition - Smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). This requirement was not met as evidenced by: Based on a file review and staff interviews, it was found that staff member(S1) was smoking inside the day care facility, which posed an immediate Health, Safety, or Personal Rights risk to the children in care.

101212(d)(1)(c) Reporting Requirements: Upon the occurrence, during the operation of the child care center…(d)(1)…a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (1) Events reported shall include the following:(C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not met as: Based on file review, staff interviews, and information gathered during another matter, the facility did not report to the Department about an incident that occurred in April 2025, that involved a staff smoking on day care premises.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229 Responsibility for Providing Care and Supervision:(a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time...This requirement was not met as evidenced by: Based on interviews conducted by LPA, on 3/2/23 a child, C1 was left unattended/unsupervised next to a bench outside of the facility next to the parking lot. This poses an immediate health and safety risk to the children in care.

Based on record review and the directors statement, the licensee did not comply with the section cited above. The facility does not maintain sleep documentation for toddlers under 24 months. This poses a potential health, safety or personal rights risk to persons in care.

Based on record review and the director's statement, the licensee did not comply with the section cited above. The director states that an infant needs and services plan is not kept for children under 24 months. This poses a potential health, safety or personal rights risk to persons in care.

HEALTH-RELATED SERVICES

Based on observation, the licensee did not comply with the section cited above in that child #1 (C1) has an Epi-Pen on site that has an expire/discard date of 3/2022. This poses a potential health, safety or personal rights risk to persons in care.

FOOD SERVICE

Based on observation, the licensee did not comply with the section cited above. Children's yogurt with an expiration date of 7/2022 was observed in the facility refrigerator. This poses a potential health, safety or personal rights risk to persons in care.
