What the inspector wrote

On 5/20/2021 @ 1:30PM, LPA Nancy Diaz conducted an unannounced inspection to deliver the findings to the above allegation. LPA met with Michelle Austen, Ass't Director. This inspection was conducted via Facetime due to COVID-19 pandemic restrictions. A tour of the facility was conducted. Observed present today were 71 children who were napping with four staff supervising in four separate rooms. This investigation was conducted by the Department's Investigations Branch. Throughout the course of investigation, interviews were conducted with the staff, reporting party, day care parents and children. Due to the lack of consistent information and details there is not enough information to support the allegation of lack of supervision. Based on the inconsistent statements and lack of disclosure, this allegation is found to be unsubstantiated, which means although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred. No citation was issued. Appeal Rights (1/16) were discussed and provided. Facility was advised to post the Notice of Site Visit and that failure to keep it posted will result in $100 civil penalty. Analyst read the report to Ms. Austen. A copy of the report will be e-mailed to Ms. Austen. Ms. Austen will confirm receipt of this report via e-mail within twenty-four hours and the reply of confirmation will serve as the signature acknowledging these rights. The Notice of Site Visit (LIC9213) must remain posted for 30 days.
