101215.1(h) Child care center directors shall have completed one of the following prior to employment: (1) High school graduation or GED; completion, with passing grades, of 15 semester or equivalent quarter units…at an accredited or approved college or university; and at least four years of teaching experience in a licensed child care center or comparable group child care program.This requirement was not met as evidenced by: Based on records reviewed, the licensee did not comply with the above regulation, as the current facility director does not possess at least four (4) years of teaching experience as required, which poses a potential Health & Safety risk to children in care.

INFANT NEEDS AND SERVICES PLAN

Based on (interview and record review, the licensee did not comply with the section cited above in not having the required LIC-9227 form in file on infants under 12 months, which poses a potential health, safety or personal rights risk to persons in care.

REPORTING REQUIREMENTS

101212(d)(1)(C): Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This requirement was not met as evidenced by: staff member tested positive for covid-19 and the facility failed to report the incident in a timely manner which poses a potential health and safety risk to children in care.

101226(a)(1) Health-Related Services. The licensee shall immediately notify the child's authorized representative if the child becomes ill...The licensee shall obtain specific instructions from the authorized representative regarding action to be taken. In the case of an illness severe enough to require isolation of the child, the center shall follow the procedures specified in Section 101226.2. This requirement was not met as evidenced by... Based on observations and interviews, staff stated three infants were in care displaying a runny nose. LPA and LPM observed one infant displaying a runny nose and one infant displaying a deep cough. This poses an immediate health, safety and personal rights risk to children in care.

101416.5 Staff-Infant Ratio. There shall be a ratio of one teacher for every four infants in attendance. This requirement was not met by evidence by...LPA and LPM observed two staff with five infants asleep and six infants awake.

101439.1 (f)(3) Infant Care Center Sleeping Equipment. Cribs shall be free from all loose articles and objects, including blankets and pillows. There shall be no objects hanging above or attached to the side of the crib. This requirement was not met by evidence by... Based on LPA and LPM's observation. One infant awake with a bib on and two stuffed toys in a crib, while another infant had a blanket draped over the portable crib. The staff failed to ensure all loose items were removed from inside and outside of the cribs. This poses an potential Health & Safety risk to the children in care.

101419.2 Infant Needs and Services Plan. The needs and services plan shall be in writing and shall include the following:Infants up to 12 months of age shall have a completed Individual Infant Sleeping Plan LIC 9227...This plan shall be signed and dated by the infant’s authorized representative. This requirement was not met evidence by: LPAs were not able to review the LIC 9227 for children in care at the time of inspection. LPAs provided the director and staff a copy of the LIC 9227 and Safe Sleep handout.
