Type A. Serious citation. Imminent or substantial risk to children. The regulator requires corrective action immediately and may impose a civil penalty.
Type B. Lower-severity citation. Corrective action required, no imminent risk. The regulator monitors compliance on the next visit.

101175 Waivers and Exceptions for Program Flexibility (b) The Department has the authority to approve the use of alternate concepts, programs, services, procedures, techniques, equipment, space, personnel qualifications or staffing ratios, or the conduct of experimental or demonstration projects, under the following circumstances: (1) Such alternatives shall be carried out with provisions for safe and adequate services, and shall in no instance be detrimental to the health and safety of any child in care. Based on observation and interview, the facility did not comply with the Departmental-issued outdoor waiver, a ratio of one teacher to two children in a public park. LPAs observed 21 children and only 6 teachers. The facility did not adhere to the waiver, which poses potential health, safety, or personal rights risk to children in care

CRIMINAL RECORD CLEARANCE
101170 Criminal Record Clearance (e)All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility:(2) Request a transfer of a criminal record clearance as specified in Section 101170(f) or This evidence is not met, as evidenced by records review, Licensee failed to ensure all employees had a criminal record clearance associated to the facility prior to employment, posing an immediate health and safety risk to children in care. The review of the staff file confirmed that four staff did not have a criminal record clearance. $100 CIVIL PENALTY ASSESSED for each staff.
