PERSONAL RIGHTS

To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by:C1's diaper was not changed prior to leaving the center and as result C1 left the center with a soiled diaper. This is a potential risk to the health and safety of children in care.

(g) Disinfectants, cleaning solutions, poisons and other items that could pose a danger if readily available to children shall be stored where inaccessible to children.(1) Storage areas for poisons shall be locked. This requirement was not met as evidenced by: LPA and Director toured the facility and observed unlocked cabinets with cleaning supplies in three out of five classrooms toured. This is a potential risk to the health an safety of children in care.

1596.99(c)(3) (c) The department shall assess an immediate civil penalty of five hundred dollars ($500) per violation and one hundred dollars ($100) for each day the violation continues .... :(3) Absence of supervision, including, but not limited to, a child left unattended, and supervision of a child by a person under 18 years of age. This requirement was not met as evidence by: Community Care Licensing was notified of an incident from facility staff and by unusual incident report that on 8/8/23, C1 was left unattended on the play yard of the facility for approximately three minutes. This poses an immediate risk to the health and safety of children in care.

PERSONAL RIGHTS

The licensee shall ensure that each child is accorded the following personal rights: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by:S1 was observed to yell and grab C1 while outside on the play structure after encountering a child with a bloody nose. This is risk to the health and safety of children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

The licensee shall provide care and supervision as necessary to meet the children's needs. This requirment was not met as evidenced by:C1 ingested food that was a documented allergy while at the facility. This poses a potential risk to the health and safety of children in care.

REPORTING REQUIREMENTS

Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (B) Any injury to any child that requires medical treatment.This requirement was not met as evidenced by: C1 required medical attention after ingesting a food item at the facility and experiencing an allergic reaction.This incident was not reported to CCL. This poses a potential risk to the health and safety of children in care.
