OPERATION OF A FAMILY CHILD CARE HOME

The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This requirement was not met as evidenced by: Based on observation during today's inspection, LPA learned that the Licensee was not home. Licensee's two Assistants were observed providing care to children.In addition, Licensee acknowledged being away from the home on today's date for more than 20% of operation hours This is an immediate risk to the health and safety of children in care.

This requirement was not met as evidenced by: Licensee was not present in the home upon arrival or during the inspection. Licensee's daughter and Assistant stted that the Licensee was out of town due to a medical concern and the childcare will be closed on 10/11/24 and 10/14/24.

ARTICLE 2. Administration of Child Day Care Licensing

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. This requirement was not met as evidenced by: Based on record review, the licensee did not comply with the section cited above in two out of three staff files review which poses a potential health, safety or personal rights risk of persons in care.

No family child care home shall discriminate or retaliate against any child or any child's parent or authorized representative because the parent or authorized representative has exercised his or her right to inspect the family child care home or has lodged a complaint with the Department against the family child care home. This regulation was not meet as evidenced by the licensee attempted to discuss concerns with individuals during the investigation process. This poses a potential health and safety risk to children in care.

Conduct in the operation or maintenance of a family day care home which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of the State of California. This regulation was not met as evidenced by the licensee was seen interacting with an individual in an inappropriate fashion. This poses an immediate health and safety risk to children in care.

PERSONAL RIGHTS

To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. This regulation was not meet as evidenced by licensee did not ensure the diapering needs of a child in care. This poses a potential health and safety risk to children in care.

REPORTING REQUIREMENTS

The licensee shall report to the Department any of the events as specified in Health and Safety Code Sections 1597.467(b)(1)(A) through (b)(1)(C) that occur during the operation of the family child care home. This requirement was not met as evidenced by, licensees did not report an unusual incident that took place at the home. This poses a potential health and safety risk to children in care.
