What the inspector wrote

On October 6, 2022 at 2:30 PM, Licensing Program Analyst (LPA) Francisco Pedroza conducted an unannounced Case Management inspection to follow-up on an Action Level Exceedance (ALE) reported to the Regional Office by Division of Drinking Water (DDW). LPA met with facility Director, Lori Chamberlain and advised her the purpose of the inspection. Director provided LPA a tour of the facility. There were 12 children in care at the time of the inspection. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five (5) years after the date of the first test. If the water testing results indicate that the facility has an ALE, an immediate response shall be required pursuant to section 101704, which may include remediation. The Regional Office received an ALE for two (2) water outlets in this facility. The Center was notified by LPA Pedroza of the results on October 4, 2022 by phone. LPA advised Director that location "E" had an ALE of 5.9 ggp and location "F" had an ALE of 26.0 ggp. Director advised that the two (2) locations are not part of the preschool and is located on the elementary school site of the facility. Director advised only the kindergarten through eighth grade students have access to the outlets. During today\342\200\231s inspection, LPA toured the entire facility and inspected the outlets in question. LPA observed that the two (2) outlets (fountains) indicated with the ALE were on the elementary school side of the facility. The fountains are located in the hallways for the school children to have access to them. The preschool classroom is located on the other side of where the school children reside. Director advised the preschool has their own reverse osmosis water filter system in the classroom that they use to provide children drinking water. Continued on 809-C The water filter system was tested during the initial test and did not receive an ALE. The staff use the water system to fill children's water bottles that they bring from home. When the preschool children go outside, they have their own fenced in outdoor recreation yard on the other side of the school. The preschool children do not pass by the two (2) outlets that tested with an ALE. Per PIN 21-21-CCP, the following outlet locations should be sampled: cold water faucets and fountains, cold water side of single-handle and dual-handle faucets that dispense both hot and cold water, filtered water dispensers, and water dispensed by refrigerators used for drinking and cooking water. The following ALE outlet sampled should not have been tested. Children do not have access to the outlet. The facility provides bottled water for children/staff in the facility. LPA advised Director that children must not have access to the outlet. Should the facility decide to use the outlet in the future for children in care, they must correct the ALE and retest to ensure they are staying in compliance.
