What the inspector wrote

On 10/9/23, Licensing Program Analyst (LPA) Elvin Baddley conducted an unannounced Required Inspection of the abovementioned Child Care Center (CCC). LPA met with Amber Villamor, Site Supervisor of the CCC and explained the purpose of the inspection. The LPA, in the company of Site Supervisor toured the interior and exterior of the CCC. The center operates from 7:00 AM to 5:30 PM, Monday - Friday and is on the grounds of the Nipomo Regional Park. The preschool uses two classrooms (Butterfly Room- 2-3 years of age, Bumble Bee Room- 3 years of age-Transitional Kindergarten) for child care. LPA observed 17 children on site during the inspection along with 3 teachers (cleared and associated) providing care and supervision. LPA notes Director Miranda Aguilar arrived on site shortly after the inspection began. The classrooms of the CCC were clean and organized. The classrooms had age appropriate toys and furnishings available for children. The CCC has an operable carbon monoxide detector which was tested at 10:45 PM. The bathroom used by children in care are in safe and sanitary operating condition. LPA observed an operable refrigerator in the CCC's kitchen which is inaccessible to children. The parents provides snacks and lunches for children in care. The CCC has excess snacks and items for lunches. LPA reviewed a posted menu along with licensing required notices and documents posted predominately on the walls near the CCC's main entrance. There is available drinking water for children both inside the classroom and outside in the play area. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP. Disinfectants, cleaning solutions, sharps and medications are in inaccessible locations (i.e. elevated cabinets,kitchen) to children in care. (CONT. 809-C, Page 2) The CCC's playground area is enclosed and the footing in the area is varied. The fence's entry/exit gate is secured. LPA observed age appropriate toys and play equipment in the play area. The toys and play equipment are in suitable condition and free of sharp, loose or pointed objects. The play structures in the playground area has adequate cushioning materials to absorb falls and an abundance of shade. No bodies of water were observed on site. Waste receptacles with tight fitting covers were observed throughout the center. Additionally, LPA reviewed electronic Sign In/Out and noted the arrival and departure times of the children are along with the information of the authorized representatives. A sampling of staff and children records were reviewed. The children\342\200\231s records were complete and found to contain emergency contact information as well as immunization records, among other required licensing documents. Staff records were reviewed and contained pediatric CPR and first aid certifications, Mandated Training certifications among other required licensing documents. Site Supervisor was reminded to ensure training and certification are current and renewed before expiration. LPA notes the last fire drill at the CCC occurred on 10/9/23. Site Supervisor informed LPA no firearm or ammunition is stored on the premises. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with facility representative Amber Villamor
