Inspector’s narrative

What the inspector wrote

T he director who was coming in from the parking lot observed C1 outside the fence. The director called out to Staff 2 to confirm if C1 was outside the fenced play area. Staff # 2 who was coming out from the classroom observed the child and called the child back. It was only at that point the child turned around and came back near the fence. Child was 97 feet away from the fenced play yard when C1 was observed. The director then ran around the fence and escorted the child back into the fenced play ground, sat down and communicated with C1. Staff 2 simultaneously notified the parent of the said incident. Based on interviews, observation and information gathered, the allegation of care and supervision is substantiated. Staff failed to adequately supervise the children, allowing 3 children to move the tires and one child exited the designated play area and walked/ran 97 feet away from the fenced play ground. It was alleged that the fence enclosing the outdoor play area was less than the required 4 feet, which allowed Child # 1 to cross over the fence. LPA observed and measured the the fence. It was confirmed that the fence measured 3.5 feet in height which is below the regulatory requirement of four (4) feet. Based on the interviews, observation and fence measurement , the allegation of inadequate fencing is substantiated Continued on LIC 9099C During today's inspection, Type A and Type B deficiencies were cited under California Code of Regulation Title 22 Division 12. LPA Reyes informed Program Director, Miranda Aguilar that this report dated 9/18/2024 documents one (1) Type A citation) which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA Reyes informed the Program Director to provide a copy of this licensing report dated 9/18/2024 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted and Report was reviewed with Program Director, Miranda Aguilar. Notice of Site Visit was issued and must remain posted for 30 days.

    (a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time,....This requirement is not met as evidenced by Child 1 managed to cross over the fenced playyard and walked/ran 97 feet away from the fence ( by rolling two tires near the fence and stacking them together) unnoticed by the staff. This poses an immediate risk to health and safety of children in care.

The fence shall be at least four feet high.This requirement is not met as evidenced by: LPA observed and measured the fence. confirming that it stood 3.5 feet in height which is below the regulatory requirement of four (4) feet contributing to C1's ability to climb the fence. This poses a potential risk to health and safety code of children in care.
