RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION
(a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time,....This requirement is not met as evidenced by Child 1 managed to cross over the fenced playyard and walked/ran 97 feet away from the fence ( by rolling two tires near the fence and stacking them together) unnoticed by the staff. This poses an immediate risk to health and safety of children in care.

The fence shall be at least four feet high.This requirement is not met as evidenced by: LPA observed and measured the fence. confirming that it stood 3.5 feet in height which is below the regulatory requirement of four (4) feet contributing to C1's ability to climb the fence. This poses a potential risk to health and safety code of children in care.
