What the inspector wrote

On 06/03/2025, at 1:30 PM, Licensing Program Analyst (LPA) Shane Loftus conducted an unannounced Annual/Random inspection of the above-mentioned Child Care Center (CCC). LPA met with Esther Magallon, Lead Teacher of the CCC and explained the purpose of the inspection. LPA notes Site Supervisor, Francisca Osuna, was not present during the inspection as she was at an off-site meeting. LPA, in the company of Family Services Advocate, Andrea Alvarado, toured the interior and exterior of the CCC. Lead Teacher Magallon did not accompany LPA in order to stay in ratio. The CCC operates from 6:00 AM to 4:00 PM, Monday - Friday. The CCC has a toddler component that has not been operating since 2023. During the inspection there were twelve (12) children supervised by three (3) staff. The classroom has age-appropriate equipment and furnishings available to children in care. The classroom is separated into a preschool area and a toddler area. LPA notes the toddler portion of the classroom has not been used since 2023. LPA observed a carbon monoxide detector in the classroom that was tested at 3:05 PM and found to be operable. There are three (3) toilets and four (4) sinks used by the children in care. All restrooms are in sanitary operating condition with hand washing soap and paper towels. LPA observed an operable refrigerator in the kitchen of the facility which contained food. The facility provides breakfast, lunch, and an afternoon snack for the children in care. LPA reviewed a posted menu in the kitchen. All required licensing notices and documents are posted by the entrance of the facility. Disinfectants and cleaning solutions are observed in the laundry room of the CCC as well as under the kitchen sink. There are currently no children enrolled who have medication needs. Continued on 809-C If needed, the CCC's medications are stored in an elevated cabinet that is locked. Sharps are stored in an elevated knife block in the kitchen. LPA notes all areas are inaccessible to children in care. The Sign In/Out forms were reviewed. The forms were found to contain the arrival and departure times, as well as signatures of the children\342\200\231s authorized guardians. The CCC has available (filtered) water for children inside and outside of the facility. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP. The CCC\342\200\231s outdoor playground areas are enclosed by chain linked fencing. The fence\342\200\231s entry/exit gates are secured. LPA observed age-appropriate toys/play equipment in the play areas. The toys/play equipment are free of sharp, loose or pointed objects. The play structures in the playground areas have adequate cushioning materials in the form of wooden chips to absorb falls. All outdoor play yards offer plenty of shade. No bodies of water are observed on site. LPA notes that toddler children and pre-school age children have their own designated outdoor play area. Again, the toddler portion of the outdoor play area has not been used since 2023. A sampling of staff and childrens records were reviewed. The children\342\200\231s records were complete and found to contain emergency contact information as well as immunization records. Staff records were found to be complete and current with CPR/First Aid training as well as Mandated Reporter training. Family Services Advocate notes no firearms or ammunition are stored on site. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://w ww.cdss.ca.gov/inforesources/child-care-licensing/public-information-andreso urces/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Facility Representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.
