    102416.2(b) - Reporting Requirements: The licensee shall report to the Department any of the events as specified in Health and Safety Code Sections 1597.467(b)(1)(A) through (b)(1)(C) that occur during the operation of the family child care home. Based on interviews and record review, the licensee did not comply with the section cited above in that the licensee failed to report an unusual incident involving a child's injury to the Department.

    (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not be limited to: (4) Poisons, detergents, cleaning compounds, medicines...pose a danger if readily available to children shall be stored where they are inaccessible to children. This requirement is not met as evidenced by: LPAs observed on the living floor a bag Miracle-Gro potting mix accessible to children in care. The licensee stated licensee's minor child was going to pot a plant in the front yard the night before leaving the bag of potting mix on the living room floor accessible to children in care.

  • PERSONAL RIGHTS

    (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. This requirement is not met as evidenced by: LPAs also observed one pac-N-play and one crib located in the living room. The licensee stated that one infant does not sleep and if the infant does sleep the licensee will lay a mat on the floor for the infant to sleep on because licensee only has the two napping equipment mentioned above.

    Based on LPA observed a regulation 2A10BC fire extinguisher in the FCCH that was last serviced on 01/23/2023, which poses/posed a potential health, safety or personal rights risk to persons in care.

    102423(a)(2) Personal Rights. Each child shall be accorded safe, healthful and comfortable accommodations, furnishing and equipment.Based on LPA's observations and parent interviews it was found there is a when licensee receives the children in the morning the children will sleep in the living room, but during nap time the children nap, have snack and play in the garage. The parents stated the children expressed the were always ants in the garage on napping equipment, and blankets, which poses an immediate health, safety or personal rights risk to persons in care.
