What the inspector wrote
On 5/22/25 at 10AM Licensing Program Analysts (LPAs) Angela Luz and Marilou Monico met with Director Brittany Strange for an
Unannounced Annual Random Inspection
. Present at the time of the inspection were 19 staff & 154 children. The facility is within capacity compliance today. LPAs provided Director the Entrance Checklist (LIC 125) and the facility was toured to conduct a Health and Safety inspection. The facility currently operates Monday-Friday 7AM-6PM.
Classrooms:
Preschool classrooms are numbered Room 8 through Room 20. Room 8A and Room 10 are not currently in use. All classrooms were inspected for age-appropriate furnishings, equipment, & adequate storage for children’s belongings. LPAs inspected the napping equipment and observed them to be stored in a healthful manner. Bedding is provided and washed weekly by families. LPAs observed sufficient toys and play materials in good condition.
LPAs observed that some children play furniture had small amounts of exposed foam in high touch areas such as armrests on couches. Director stated that they would cover the exposures with tape to prevent access to the foam from children in care. Director has already ordered replacements.
LPAs observed the cleanliness of floors & surfaces, the presence of a fully functional carbon monoxide detector, smoke detector/fire alarms, and a fully charged 3A40BC fire extinguisher that is accessible throughout the facility. The center is equipped with a fully stocked first-aid kit and available in the classrooms. The isolation area for when a child is sick is the office.
Ratio:
During the facility tour with Director, LPAs observed 1 staff, Staff 3 (S3), alone supervising 7 children in Room 13. During the tour, Director stated that S3 was a fully qualified teacher. During record review, LPAs noted that S3 had 9 applicable semester units. Director was instructed to have S3 enroll in at least 2 semester units so that they can be a minimally qualified teacher and supervise children by themselves. LPAs reminded that until S3 completes the required units, they cannot open or close the center alone.
All other preschool classrooms were within ratio compliance.
Food Service Areas:
All center provided food items are properly labeled & stored separately from cleaning supplies. The facility provides AM and PM snacks. Authorized representatives either bring lunch or purchase a hot lunch delivered to the facility by the Action Day elementary school cafeteria that is located on 3500 Amber Drive San Jose, California. Food preparation area is clean, adequately equipped, & free from hazardous materials. Snack menu is posted one week in advance and available for review. The same snack menu is used each week. Solid waste bins are equipped with tight fitting lids. Drinking water is accessible by children in the classrooms. Facility provides filtered water in the classrooms and low fat - milk. LPAs observed the children’s water bottles are labeled with their name.
Bathrooms:
Facility has separate staff and child designated bathrooms. Toilets and faucets are in safe and sanitary operating condition. The children can reach their designated sinks, toilets, and supplies.
Outdoor Play Area:
The outdoor play areas are fully fenced and have ample shade available. All equipment and surfaces are free from hazards. There are no bodies of water, or free-standing water accessible to children. LPAs observed age-appropriate outdoor toys and materials for the children. Large play structures are securely installed into the ground and the ground surrounding the play structures is sufficiently padded with woodchips and in good condition for safety. Drinking water is provided in water bottles when children are outside. Director states there are no firearms on the premises.
Records:
All individuals subject to criminal record review have a clearance and have been associated to the facility. LPA reviewed the facility roster & personnel report and copies were obtained. At least one opening/closing staff member has a current Pediatric CPR/First-Aid Certification. LPA observed all required postings in a publicly accessible area. LPA reviewed the sign in/out sheets. Emergency Drills are recorded and performed at least every six months, last drill was on 4/25/25.
LPAs reviewed 10 random children files during today's inspection for the following records: Admission Agreement, Personal Rights (613A), Identification and Emergency Information (LIC700), Notification of Parents Rights (LIC995A), Consent for Emergency Medical Treatment (LIC627), Physician’s Report (LIC 701) and Immunization records. All children records reviewed today were complete.
LPAs reviewed children's medication records and found that 3 of 4 medications did not have an authorization form for the facility to administer the medication. LPAs reminded Director that for each prescription medication, the licensee shall obtain, in writing, approval and instructions from the child's authorized representative for the administration of the medication to the child.
LPAs reviewed 4 staff (S1-S4) files for the following records: Health Screening Report (LIC 503), Statement Acknowledging Requirement to Report Child Abuse (LIC 9108), Employee rights (LIC 9052), staff qualifications, immunization records, and required training. All staff files reviewed today were complete.

Criminal Record Clearance
:
Director, Brittany Strange, was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
MyChildCarePlan.org:
Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.
Unusual Incident/Student Injury Report:
Effective August 1, 2003 California Law requires Child Care Licensees to report unusual incidents or injuries to children in care to child’s parents and to the Department of Social Services using the Unusual Incident/Injury Form (LIC 624). Incidents must be reported within 24 hours to the regional office by phone and the written report, LIC 624, within 7 calendar days.
Lead Testing:
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018,
requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for
drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.
For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP).
LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.
Incidental Medical Services (IMS):
This facility does provide Incidental Medical Services (IMS). LPA inspected storage of medications and equipment/supplies, and reviewed children’s, personnel, and administrative records. All children’s medications are securely stored, accompanied by their original packaging, and are in compliance with expiration dates. For IMS information see PIN 22-02-CCP. Deficiency:
LPAs Angela Luz and Marilou Monico informed Director Brittany Strange that this report dated 5/22/2025 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.
Also, LPAs Angela Luz and Marilou Monico informed the Director Brittany Strange to provide a copy of this licensing report dated 5/22/2025 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
