PERSONAL RIGHTS

To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by licensee's assistant Mayra Coty hit children in care. This poses an immediate risk to the Health, Safety or Personal Rights to children in care.

Based on record review, the licensee did not comply with the section cited above. Assistant Maria Saucedo is missing LIC9052 which poses/posed a potential health, safety or personal rights risk to persons in care.

OPERATION OF A FAMILY CHILD CARE HOME

Based on observation, the licensee did not comply with the section cited above. LPAs observed two Clorox wipes containers, floor cleaner, stainless steel cleaner under the kitchen sink and a knife and other objects in kitchen drawers accessible to children which poses/posed a potential health, safety or personal rights risk to persons in care.

ADMISSION PROCEDURES AND PARENTAL AND AUTHORIZED

Based on record review, the licensee did not comply with the section cited above. Child 1 is missing LIC995 which poses/posed a potential health, safety or personal rights risk to persons in care.

Family Day Care Homes

Based on record review, the licensee did not comply with the section cited above. Assistant Maria Saucedo does not have immunization records on file which poses/posed a potential health, safety or personal rights risk to persons in care.

INFANT SAFE SLEEP

Infant Safe SleepCribs or play yards shall be free from all loose articles and objects.This requirement was not met as evidenced by; infant 1 and 2 were observed sleeping in cribs with blankets. This poses an immediate health and safety risk to children in care.

"Family day care home" means a home that regularly provides care, protection, and supervision for 14 or fewer children, in the provider's own home, for periods of less than 24 hours per day, while the parents or guardians are away, and is either a large family day care home or a small family day care home. This requirment was not met as evidenced by;Licensee is not living in the home in which she is licensed.

STAFFING RATIO AND CAPACITY

STAFFING RATIO AND CAPACITYTwelve children, no more than four of whom may be infants; This requirement was not met as evidenced by: Licensee was caring for five infants. Which poses a immidiate health, safety risk to children in care.

INFANT SAFE SLEEP

INFANT SAFE SLEEPThe provider shall supervise infants while they are sleeping and adhere to the following requirements: (1) The provider shall physically check on the infant every 15 minutes. Based on record review, the licensee did not comply with the section cited above as all five infants under 2 years old were missing 15 min. check sleeping logs in which poses/posed a potential health, safety or personal rights risk to persons in care.

CRIMINAL RECORD CLEARANCE

Criminal Record Clearance - All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing, or volunteering in a licensed facility: Obtain a California clearance or a criminal record exemption as required by the Department. This requirement was not met as evidenced by: Licensee's adult son, Armand Akbari, was residing in the home from March 2020 thru August 2021 without fingerprint clearance. This poses an immediate risk to the health and safety of children in care.Civil penalty of $500 was assessed.
